League Testimony . The bill which would have updated Oregon’s 2007 GHGE targets to reflect current science is now dead. The League fines this unacceptable, and we are considering a letter to Leg Leadership and the Governor. Budget Omnibus Bill - End of Session JW&M committee: Support funding for: Healthy Homes, EV Rebate, Climate-Friendly Micro-mobility transport and Environmental Justice related Worker Relief funding Programs all totaling $59 million. Environmental Justice: Budget Omnibus Bill – End of Session: Continue Oregon Worker Relief Funding $9M. Senate Energy and Environment By Claudia Keith The committee moved SB 1581-2 to the Senate floor with a do-pass recommendation (Hayden objecting). As amended, the bill simply requires PGE and Pacific Power to verbally report to the legislature by January 15 each year on "activities, including plans or preparations, that the investor-owned utility has taken or is taking toward participating in a regional energy market.” The amended bill has a sunset date of 1/2/2031. Supporters said the bill would ensure that the legislature stays informed on the emerging impacts of competing power markets even though the PUC regulates these activities. Find in previous LR reports additional background on each CE priority. 1. Natural and Working Lands : SB 530 LWVOR Alert : Work Session 3/27. The fiscal has not been posted. An amendment may get posted to simplify multiple-agency policy implementation. The League continues to be an active coalition member. 2. Resilient Buildings (RB): LWVOR Alert . I understand that the HOMES part of the federal IRA hasn’t released guidance yet, this makes it difficult for the legislature to know what to count on and what matching might be needed. 3. Environmental Justice (EJ) 2023 Leg bills: The League joined the Worker Advocate Coalition on 2/13 and SB 593 is one of two bills the League will follow and support. The ‘Right to Refuse dangerous work’ SB 907 , League testimony . Public Hearing (#2) and Work Session is 3/28 . There are issues with this bill that need to be addressed, in an expected amendment. 4. Oregon Climate Action Commission (currently Oregon Global Warming Commission): Roadmap , SB 522 , 3/23. -2 amendment was posted 3/22. 5. Other Governor Climate / Carbon Policy Topics: See 20-04 Executive Order topics . This area includes other GHG emission mitigation/reductions (DEQ) and new clean renewable energy (DOE), OHA public health, and ODOT (Dept of Transportation) policy and funding bills. 6. CE related total 2023-2025 biennium budget: The governor’s budget * was published Jan 31; Kotek’s budget priorities . A main funding problem concerns how the favorable ending current period balance, estimated to be >$765M, can be used. It will take a 3/5 vote to pass this proposed change. We provided testimony on the Oregon Dept. of Energy (ODOE) budget ( HB 5016 ), requesting additional agency requests that were not included in the Governor’s budget. Another major issue, the upcoming mid-May Forecast will provide required budget balancing guidelines. Other CE Bills By Claudia Keith HB 2763 : Creates a State public bank Task Force. Like RB task force the 23 member Task Force is required to recommend no later than Jan 2024. “ The report must include a recommendation for a governing structure for a public bank.” This topic will likely have a bill in the 2024 session. HB 3016 community green (tree canopy) infrastructure, Rep Pham K, Senator Dembrow, Rep Gamba. Work Session was 3/15 . Legislative Summary description . Fiscal is not clear for agency FTE adds, maybe ~$900K, nor source of grant funds. House Bill 2816 , Recent amendments posted “… scheduled for a committee (work session) vote on March 27, would require every (major) carbon emitter to follow the same rules as major utilities. (data centers) A 2021 law set ambitious timelines for utilities, including the state’s two biggest electrical providers, Portland General Electric and Pacific Power, to lower their carbon emissions and switch to non-carbon-emitting power sources by 2040.” Oregon could tighten climate regulations for data centers , cryptocurrency farms | Oregon Capital Chronicle. No fiscal posted. Climate Solutions testimony . HB 2713 - 1 , PH 3/29 and work session 4/3. Local Regulation of Fossil Fuels: home rule cities and counties have constitutional authority to prohibit or limit use of fossil fuels in new buildings or installation of fossil fuel infrastructure. Permits cities and counties, whether home rule or not, to prohibit or limit use of fossil fuels in new buildings or installation of fossil fuel infrastructure. No fiscal posted. House CE&E Meeting By Greg Martin The committee moved HB 3418-1 to the floor with a do-pass recommendation, with referral to Joint Tax Expenditures. The bill would extend the sunset date of the Solar and Storage Rebate Program from 1/2/2024 to 1/2/2029. ODOE would have to waive the requirement that construction begin within 12 months of an award if construction was delayed because of supply chain or workforce disruptions or shortages due to the COVID-19 pandemic. Fiscal impact is estimated at $547K for 2023-25, $703K for 2025-27. ODOE received a GF appropriation of $15 million in 2021-23 and anticipates that all funds will be obligated by the end of the biennium. If additional funding were provided to carry the program forward, ODOE would change three existing limited-duration administrative positions into permanent positions. Senate E&E By Greg Martin The committee sent these bills to the floor with a do-pass recommendation: SB 145 (w/ referral to Joint Tax Exp.), extends until 7/1/2032 the sunset date for the property tax exemption for the High Desert Biomass Coop, which burns "hog fuel" to produce hot water and steam for delivery in Burns. No fiscal impact (or comments, please). The committee also heard testimony for Sen. Hayden's SB 1015 , which would allow accelerated depreciation (over two years) of “carbon reducing upgrades” that could include replacement of older heavy-duty diesel trucks, manufacturing and building upgrades, adoption of clean vehicles for fleet use. Would apply to tax years beginning on or after 1/1/2020. No fiscal impact statement was available but committee members seemed favorable. Interstate 5 (I5) Bridge Project By Liz Stewart Final design is undecided. Stakeholders have been identified and engaged. Draft Environmental Impact Statement to be released early this fall, with a 45-60 day comment period once released. Final environmental impact decision anticipated in 2024 Finance plan will be released in March and updated annually Section 106 impacts (historical, cultural, archeological): An online public open house is planned for April related to Section 106 impacts. The Equity and Mobility Advisory Committee (EMAC) has worked to help identify strategies to improve outcomes and access to travel choices for all demographics. Jump to a topic: Initiatives Courts and Privacy Government Ethics Initiatives HJR 3 (require signatures in every county) and HJR 11 (greatly increase the number of signatures required) were both heard in House Rules 3/10. Either of these constitutional amendments would have to be voted on in a general election. However, either would destroy the initiative process as we know it by making it much, much more difficult to get an initiative on the ballot. The legislature would, in effect, be insulating itself from being second-guessed by the voters. However, the whole purpose of the initiative process is for voters to have a say in issues that the legislature has failed to deal with. The League strongly opposes both these bills. Courts and Privacy By Becky Gladstone This week’s Joint Legislative Council Public Records committee hearing had more background for panelists, noting that cybersecurity and IT support are like plumbing, you don‘t think about them unless they don’t work. Tuesday’s Future of FEMA: Perspectives from the Emergency Management Community , hearing video highlighted an additional 800 in staffing cuts projected on top of 300 already cut. Anticipate urging to protect FEMA. HB 3012 calls for 16 and 17 year olds who are registered to vote, being able to cast ballots soley for their school districts. The League lacks a position for a specific optimal voting age. We have Strongly supported learning to vote, both with repeated legislative advocacy and for decades with our Mock Elections and Civics Education curriculum. See League COMMENTS filed , including in the hearing video , at time stamp: 1:14:49 to 1:15:58. Verbal testimony was limited to one minute. HB 2581 to coordinate expanded resiliency services with the State Resiliency Officer (SRO), is scheduled for a Senate side work session after passing a House floor vote last week, League testimony . HB 2341 , to add veterans’ email addresses to shared information, has a Senate side public hearing scheduled, after passing a House floor vote with 58 in favor, two excused, League testimony . SB 470 is scheduled for a work session, League testimony filed and presented in support. This bill to protect lodgers’ privacy from illicitly taken videos, seemed likely to generate amendments from discussion in the public hearing but none have been recorded. Upcoming SB 414 is an AI bill, making disclosing fake intimate images a crime. It was slated for a public hearing, removed and rescheduling is anticipated, with League support. HB 5537 We anticipate speaking to this SoS budget bill, during the week of April 7. Government Ethics By Chris Cobey SB 983 to be heard 3/17 in the Senate Education committee, would allow a local public official to discuss, debate and vote on a local budget that includes compensation for the public official or their relative after announcing an actual conflict of interests. This would be a major change in ethics laws . Small local jurisdictions are where most of the conflicts of interest arise. HB 2330 would create a task force to come up with ideas to address fraudulent schemes that target the elderly. The legislation includes activity-based metrics and community impact metrics for net carbon sequestration and storage in natural and working lands and establishes carbon sequestration and storage goals. (Related, see interim NR committee SB88 ). The League continues to be an active coalition member. Environmental Justice: A number of 2023 Leg bills are expected to address new and ongoing related topics. HB2763 Create a State public bank Task Force, Rep Gamba, Sen Golden, Rep Walters OPUC Oregon Public Utility Commission - CE Team Volunteer By Claudia Keith OPUC held a special informational meeting Jan 10 to update commissioners on measures to ensure the resource adequacy (RA) of the regional electrical grid. This meeting served as a technical conference for OPUC commissioners on the status of resource adequacy (RA) in the western U.S. Major players made "inside baseball" presentations summarized in the attached notes. Pursuant to docket UM 2143 , OPUC staff recommended that the commission develop rules to establish a binding Oregon RA program for regulated utilities and electric service suppliers. Staff is targeting March 2023to begin rulemaking, following public comment. Western Electricity Coordinating Council ( WECC) forecast WECC presented its latest forecast of the regional grid reliability and security risks. Interconnection-wide, the risk is expected to grow in frequency and magnitude over the next 10 years, largely because resource variability will increase, except in the OR-WA-ID subregion where the resource mix will remain relatively stable. The rate of planned resource growth is comparable to historical resource growth, but challenges such as supply chain disruption, skilled labor shortages, and siting issues could increase risk. Reliance on imports will grow in many cases and could be put at risk by transmission capability. WECC emphasized the need for immediate action to address long-term RA risks. Northwest Power and Conservation Council (NWPCC) forecast NWPCC’s annual RA assessment looks ahead 5 years aiming to provide early warning of resource shortfalls and to ensure that resource strategies will result in adequate future power supplies. The latest assessment found that the 2027 regional power supply would be greatly inadequate if the region relied solely on existing resources and reserve levels with no new energy efficiency measures. NWPCC’s strategy for increasing resources and reserves would ensure an adequate power supply if demand growth remains consistent. Western Resource Adequacy Program (WRAP) update All Oregon-regulated investor-owned utilities and many electric service suppliers take part in the Western Power Pool’s WRAP, the first region-wide RA program. This overview described the WRAP participation agreement and delivery commitments. WRAP filed its initial tariff with FERC at the end of August 2022, received a deficiency letter from FERC in November, filed an amended tariff in December, and expects FERC’s response next month. UM 2143 investigation update and straw proposal for state RA standards OPUC staff recommends that the commission develop rules to establish a binding RA program for all Oregon entities. This presentation summarized key elements of the straw rules proposal released in September, with themes from public comments and the October 2022 stakeholder workshop. Natural Climate Solutions At the request of the Oregon Climate Action Committee , OCAC (formerly the Global Warming commission), SB1525 in HCEE, PH 2/26, work session 2/28. supports Oregon’s transition to clean energy. However, several of the dates in the 2023 legislations could not be met due to delayed funding and grant issues. The $10 million fund to carry out work promoting carbon sequestration on Oregon’s natural and working lands (OWEB, ODA, ODFW, ODF) needed to be moved out by a year. The OCAC overseeing implementation of the Natural and Working Lands bill felt more time was needed to complete three studies on Carbon Sequestration and Storage Inventory, Natural Climate Solutions Workforce, and its Carbon Sequestration Goal. House and Senate Climate Notes By Claudia Keith The House passed HB 4090 by a vote of 39-19. The bill would prohibit the Energy Facility Siting Council (EFSC) from exercising jurisdiction over or requiring a site certificate for an energy facility that is a renewable energy facility or transmission line, which is sited wholly within federal lands and is subject to review under the National Environmental Policy Act. Several Reps opposed the carve-out allowing the EFSC to retain jurisdiction over nuclear power plants, saying we can’t achieve our “green” energy goals without nuclear power. Bill Chief Sponsor Rep. Gamba responded that the carve-out does not take nuclear off the table, but says the EFSC (which was created to address concerns about nuclear energy siting) must still be involved in the approval of such a project. The Senate passed SB 1596 A (Right to Repair) by a margin of 25-5 (Bonham, Hayden, Knopp, Linthicum, Robinson), League testimony . The House Business and Labor public hearing is 2/26. House Committee for Energy & Environment By Claudia Keith The committee voted 7-3 to move HB 4112-4 to the House floor with prior reference to Joint W&M. The bill directs DAS to adopt rules to govern procurements from CE technology manufacturing companies that DAS conducts on behalf of state agencies; creates the Oregon Clean Energy Technology Manufacturing Opportunity Fund, from which OBDD is to develop a program to award grants and make low-interest loans to attract and support CE tech manufacturing companies and foster job creation; and directs the Governor to establish a 15-member Clean Energy Technology Leadership Advisory Council. Fiscal note calls for $20 million GF in 2023-25 to OBDD for deposit into the new Opportunity Fund plus two new full-time analysts; $107K Other Funds in 2023-25 to DAS for a permanent part-time analyst and expenses; and $179K to DAS in 2025-27. During discussion, Rep. Owens said he would vote yes because CE technology can be an economic driver, but he is concerned about preferences for employers that agree to provide benefits for disadvantaged workers and businesses and to enter into community benefit agreements (project labor agreements or PLAs). He hopes in the future we can have more discussion about how this sort of program affects rural communities. Rep. Osborne objected to PLAs in principle saying they counteract good practice. It’s been 15 years since targets were set. There may be a divestment in the dirty coal bill specific to PERS funds. It’s unclear at this point if any follow-up on 2023 HB 2763 State Public Bank ( vetoed / unsigned by Gov Kotek ) will be filed. There will likely be an opportunity for LWVOR (with many other Climate coalition members), to oppose any natural gas legislation which weakens current DEQ and or DOE GHGE reduction goals. (See DEQ CPP rulemaking status). It is expected the following policy/budget topics will be moved to the 2025 long session: Water, Transportation, Air, Fracking moratorium update, DOE climate curriculum, and likely the data center (and crypto mining facilities) GHG emission reduction goals. Natural and Working Lands/Natural Climate Solutions The NCS coalition met recently and discussed collecting comments on the Institute for Natural Resources (INR) Report published in September. The Institute for Natural Resources (ORS 352.808) “works to deliver management-relevant information that informs discussions and decisions about the long-term stewardship of Oregon’s natural resources, and works to advance centralized, science-based natural resource information for Oregon and the Pacific Northwest.” This is part of the climate package that included the Natural Working Lands bill, HB 530 (2023 LWVOR testimony ) about meeting Oregon’s carbon sequestration and storage goals. There were discussions about the new Advisory Council additions that were part of the bill. There were questions about the process and approvals needed for allocations of the initial $10 million NWL Fund to be used for increasing agency budgets for grants and for increased capacity within the agencies to address climate change. Budget: Given the Nov 15 favorable Oregon Economic and Revenue Forecast, Climate related Budget / funding state agency and environmental justice items will likely be added to the end of session budget bill. The update is long overdue, as it would be the first time Oregon has adjusted its climate targets in over 15 years.” States with net-zero carbon emissions targets - CSG ERC Oregon Global Warming Commission Meeting November 17, 2023, 9am – 1pm Online Meeting “Meetings of the Oregon Global Warming Commission are open to the public. Public comment is welcome. Agenda items are expected to be addressed in the order listed during the meeting. However, the Chair may elect to reorder agenda items during the meeting or to delay action on an item until the next meeting to accommodate the priorities of the Commission…” Oregon Public Utility Update By Greg Martin HB 2021 requires Oregon’s large investor-owned utilities and electricity service suppliers to decarbonize their retail electricity sales to maximize direct benefits to local communities. The utilities’ Clean Energy Plans (CEPs), overseen by OPUC, are the key regulatory mechanism for implementing the emissions reduction targets prior to 2030. OPUC undertook this investigation to identify key implementation issues that are within the commission’s authority to address. Administrative Law Judge John Mellgren presided over the hearing. Parties and intervenors included PacifiCorp, PGE, Oregon CUB, Green Energy Institute, Rogue Climate, NW Energy Coalition, Oregon Solar and Storage Industries Assn., NewSun Energy, Climate Solutions, and the Sierra Club. Discussion revolved around this memorandum’s four major issues. OPUC made no determination on these issues but sought input on its legal authority to require utilities to address certain factors arising from HB 2021 -- for example, the force of policy statements in the statute as distinct from concrete requirements. Not surprisingly, environmental groups argued that OPUC should have broad latitude in applying the law's language in utility proceedings. An interesting comment toward the end of the hearing: Regarding OPUC's approach to ensuring that utilities demonstrate “continual progress” toward meeting the clean energy targets, NewSun's counsel asserted that Oregon utilities don't fear the consequences of failing to show continual progress, whereas utilities in Washington are "scared" about it. Oregon Global Warming Commission By Josie Koehne The OGWC started off with Debbie Colbert, Deputy Director of the Oregon Department Fish & Wildlife stating that the $10 million approved by the Legislature available Natural & Working Lands Fund won’t be available for distribution to agencies for carbon sequestration incentives and technical assistance until April, 2024. The NWL Fund will be distributed to four agencies, ODFW, AG, ODF and OWEB, which ODOE will be distributing at the recommendation of the Global Warming Commission. ODOE is building capacity within its agency for this climate work. Catherine Mac Donald, OGWC Chair, gave an overview of the Natural and working Lands Proposal (approved Aug 4, 2021) and its proposed implementation strategies as outlined in bundled climate bill, HB 3409, passed in 2023. She went over requirements of the bill sections related to Natural and Working Lands, Sections 53-67 (originally HB 530). NWL requirements in the legislation: Establishes a 15-member Advisory Committee for implementing the NWL bill Identifies the Institute of Natural Resource of OSU (Lisa Gaines in charge) to build a baseline inventory of carbon for blue, brown and green carbon (wetlands, agriculture, grasslands, rangeland, and forestlands. The methodology for doing this inventory were Basic (EPA guidelines with additional modifications) and Advanced, which is more robust and collects more data points. The four OGWC subcommittee members (Apter, Ford, MacDonald and Rietmann) recommended using the Advanced methodology. The INR report included recommendations that are open to public comment to be collected through December, with the approval vote on this revised INR Report scheduled for January. So far over 1000 comments have been submitted. Includes Tribal consultation and process To be advised by both a Technical Team and the Advisory Committee Requires a Workforce Study and Report in consultation with the four agencies Defines a framework with metrics for Community Input (Pages 28-31 in the INR report) Includes Workforce Training and Assessment Includes activity-based metrics for carbon sequestration A discussion followed of the advisory committee member selection process, for their expertise, and expansion of representation on the advisory as an option in the bill. Note: LWVOR supports the comments of Lauren Anderson of Oregon Wild during this meeting on the lack of specificity in the forestry recommendations for activity-based metrics. In addition, our LWVOR comments: The term "better managed forests” as used in OSU’s INR report often carries the unstated assumptions of using the private industrial practices of fertilizing and herbicide use (which harms natural microbial action), and “thinning to reduce ladder fuels” with burning slash piles “to reduce wildfire risk.“ These practices would add CO2 to the atmosphere and reduce carbon sequestration while compacting the soils and interfering with beneficial microbial action that captures CO2 in the soil. As observers on the ground in federal and state public forests ((Paula Hood's group of PNWCA forestry team) have reported, “thinning” often equates to clear-cutting, so this term must be carefully defined and monitored. What is appropriate for industrial forestry is inappropriate for public lands with its requirements to serve many public purposes beside timber products production. Since fire resistant mature and old growth trees store far more quantities of carbon than young growing trees, their protection and promotion on both public and private forests should be included as a major carbon sequestration strategy. In addition, our limited NWL carbon sequestration funds should not be used for wildfire mitigation, which will soon get ample sources of federal and state funding. November Leg Day Policy Committee Meeting Review By Arlene Sherrett On November 13, 2023, the Oregon Department of Energy (DOE) hosted a webinar about the implementation of the State Energy Strategy authorized by HB 3630 . The webinar introduced the process for creating the Energy Strategy but did not go into the strategy itself. Brief presentations were given by each State of Oregon department that will have a role in formulating the strategy and implementing laws concerning climate change in Oregon. Oregon PUC, DOE, DEQ, DLCD, DOT and Business Oregon were represented, each giving their perspective on the strategy and the energy landscape in Oregon. Stakeholder engagement for the project was explained and public comment opportunities were highlighted. The process will culminate in delivery of a final report to the Governor and the Legislature on November 1, 2025. Learn more and sign up for email updates at the State Energy Strategy webpage . Senate Interim Committee on Energy and Environment – November 8, 2023 The Committee met for informational panels on four topics. Denmark's GreenLab and Circular Energy Infrastructure Development Christopher Sorensen, CEO, GreenLab, a Danish private/public collaboration, presented how the GreenLab concept works and how it helps with the transition to clean energy. By transforming any waste power, heat or fuel, in a usable form, storing that energy and preserving it for use to provide something someone else in the complex needs, all the businesses work together in a symbiotic fashion. Mr. Sorensen stated that an agreement had been reached between the Danish Foreign Ministry, the USDA, and GreenLab to share these concepts and to scout sites in the US that might be suitable for building similar facilities. Abandoned and Derelict Vessels Vicki Walker and Christopher Castelli from the Department of State Lands presented the development of a program to provide for proper disposal of abandoned vessels. The Department has the responsibility to clean up abandoned vessels and protect our waterways and ecosystems from toxic chemicals often found onboard. Since the Department also has the responsibility to provide funding for Oregon schools, expenses from vessel clean-up deplete school funding coffers. The Abandoned and Derelict Vessels (ADV) program will be designed to focus on prevention to avoid these high costs wherever possible. Of the vessels cleaned up and dismantled so far, one cost $1M and another cost $7M. The Legislature had given State Lands $18.8 M initially from the Monsanto settlement to do this work. Residential Solar in Oregon Christy Splitt, Government Relations Coordinator and Rob Del Mar, Senior Policy Analyst, both with the Oregon Department of Energy, presented on Oregon’s existing solar and storage incentives program. Mr. Del Mar reported that the Department has applied for a Federal Grant program called Solar for All, which would cover more people. Pacific Northwest Regional Clean Hydrogen Hub Janine Benner, Director of the Oregon Department of Energy, gave an overview of the Pacific Northwest Regional Clean Hydrogen Hub which has gained initial acceptance from the US Department of Energy, to try for one of the grants it is offering. Kate Hopkins, Chief Development Officer for NovoHydrogen, introduced the concept for a hydrogen node planned for Baker, Oregon, to manufacture and supply fuel for heavy trucking. House Interim Committee on Climate, Energy, and Environment The Committee hosted three informational panels at their 11/6/2023 meeting Transmission 101- Local electricity and high-voltage transmission professionals appeared before the committee for an informational update on issues with Oregon’s current electricity transmission system. With no established planning and controlling authority in place for the Northwest, panel members discussed how local transmission planning entities (the BPA, OPUC, and individual investor-owned utilities with individual IRP processes) can cooperate on a least cost, inclusive plan to adequately address the complexities of a highly interconnected system, design transmission capacity additions that serve everyone, and provide for the expanding electricity needs of the population between now and 2050, while at the same time, finding equitable cost-sharing solutions. Climate-smart agriculture Dr. Jeffrey Steiner, OSU, Greg Harris, Threemile Canyon Farm, and Shelby Leighton, Nez Perce Tribe Enterprises, appeared before the Committee to share the climate-smart agriculture project they have been working on. For this five-year, $50 billion USDA grant project, the group will grow potatoes (yes, they do taste different when grown using smart practices) using climate-smart techniques, such as use of cover crops, crop rotation, soil compaction, and regenerative ag. Across the US, USDA grants are being invested in similar research projects with regionally specific crops. Scientist Dr. Jeffrey Steiner is researching if climate-smart practices work and if they can increase CO2 sequestration in soils. Wildfire Funding Workgroup update A workgroup was convened by Senator Steiner to examine problems with wildfire funding. Dr. Steiner has been working with Doug Grafe, Wildfire and Military Advisor from the Office of the Governor, and has put together a group of experts to work on this critical problem until resolution is found. The workgroup has already identified one way to simplify funding by addressing the complexity in funding pathways, possibly through legislative action. Action probably will not be taken until the 2025 session. See Agenda and Meeting materials. Climate and environment bills for next session Rep. Mark Gamba gave a presentation to climate group Engineers for a Sustainable Future on November 14, 2023. He spoke informally about the difficulties of getting bills through the Legislature, including the number of bills to consider and the short time to consider them in, and the lack of organization around climate issues. Rep Gamba will be initiating the need for electrical transmission lines in the region. He wants to see a regional transmission organization (RTO) created by 2030, putting planning coordination into the hands of an appropriate entity. He would also like to create an organized climate caucus with funding in the state budget. A caucus would provide a way for climate bills to be considered together and be handled more effectively. Numerous lawsuits are challenging Oregon’s DEQ CPP regulations. Gas, oil companies argue against Oregon’s emission deadlines during Court of Appeals hearing -- Several dozen people gathered afterwards to support those rules, which require a 50% cut in greenhouse gas emissions by 2035. -– Oregon Capital Chronicle. Here is one example of how to track them. Basically, there are several active state federal lawsuits , (Nov 2023 update) some of which could assist in meeting Oregon's Net Zero GHG Emissions before 2050 targets, and other lawsuits, that challenge the current Oregon DEQ CPP policy, which would limit the use of fossil fuels, including diesel, natural gas, and propane over time. HB 3445 gives a county the authorization to adopt an ordinance to make Measure 114’s permit-to-purchase requirements optional for county sheriffs, police chiefs, gun dealers, and county residents. Although the bill will likely fail to progress and has not yet been referred to a committee, we will keep you informed of its progress. SB 993 , sponsored by Senator Brian Boquist and referred to the Senate Judiciary, is an interesting bill that we will be keeping an eye on. It creates the crimes of pointing a firearm at another person and unlawful carrying of a handgun, increases penalties for crimes of criminal trespass while in possession of a firearm, and directs the Oregon State Police to maintain a database of those convicted of crimes related to firearms. Meanwhile, gun sales continue to soar in Oregon. Here are some alarming facts from a recent article in 247wallst.com : “ The FBI conducted an estimated 55,581 background checks related to firearm sales in Oregon in January 2023, up 88.7% from the same period in 2022. Adjusting for population, this comes out to about 13.1 background checks for every 1,000 people, the most among states.” Criminal Justice By Marge Easley & Karen Nibler The League submitted supportive testimony on two bills, both heard on February 27 in the House Judiciary, related to programs at Coffee Creek Correctional Facility. HB 2535 establishes a doula program for pregnant and postpartum adults in custody that would provide an array of doula services overseen by an onsite pregnancy coordinator. The bill also prohibits shackling during labor, childbirth, or postpartum recovery. HB 2731 authorizes the long-term continuation of the Family Preservation Project under the auspices of the Oregon Justice Commission (OJC) and the Department of Corrections. This program, supported by the League in previous sessions, promotes family connections during incarceration and is a lifeline for inmates and their children. The League submitted testimony on HB 2327 , which was heard on March 2 in the House Judiciary Committee. The bill permits county juvenile departments to provide preventive services for children under 12 who engage in delinquent behavior. The League is pleased that another criminal justice bill we have supported is moving forward: SB 529 , relating to alternative incarceration programs for those suffering from addiction disorders, passed the Senate on January 22 and is now awaiting referral to a House committee. The Senate Judiciary scheduled SB 519 A for a hearing on March 2 on an amendment. The bill related to juvenile delinquency records and expunction will stipulate the process within the juvenile system. The amendment proposes requirements for the destruction of records and possible damages for confidentiality violations. The League did not testify on the legalities in this bill but supports expunction of juvenile records. SB 763 is a related bill that has opposition from the District Attorneys Association and has not moved forward. Human Services By Karen Nibler Senate Human Services took testimony on March 27 from many citizens on the need for food programs through the Department of Human Services . SB 609 , SB 610 and SB 856 covered higher education graduate students, immigrants from Asian countries and Pacific Islanders, who expressed the need for the food programs. The Human Services Ways and Means Subcommittee will consider the costs and the decisions in the Department of Human Services Budget process. Housing By Nancy Donovan and Debbie Aiona Significant strides are being made to address Governor Kotek’s executive order declaring housing and homelessness a state emergency. A bipartisan and bicameral process is in action, and bills are being passed on near unanimous votes. Legislators are meeting more frequently than originally scheduled. HB 2001-11 Oregon Housing and Community Services Governor’s Budget The Oregon Legislature is moving quickly to address urgent homeless and housing priorities. On 2/28, the House Committee on Housing and Homeless passed HB 2001-11. The estimated $200 million dollar package will fund the Governor’s Homeless State of Emergency, prevent more people from becoming unhoused, make affordable housing a top priority for the state, and much more. The bill is headed to Ways and Means, and lawmakers aim to pass the final package by mid-March in response to the current housing and homeless crisis facing Oregonians. A complete list with descriptions of the bill’s 11 amendments can be found at: HB 2001-11 Metro Regional Multi-Agency Coordination Group On Friday, February 24, Governor Kotek convened the first meeting of the Metro Regional Multi-Agency Coordination Group. This group includes representatives from local jurisdictions, public housing authorities, local homelessness agencies, rapid rehousing service providers, shelter developers and operators, landlord associations and behavioral health providers. Its formation came out of the governor’s declaration ( EO 23-02 ), of a homeless state of emergency. MAC groups also will be established in other regions: 1) Central Oregon, 2) Eugene, Springfield, and Lane County, 3) Medford, Ashland, and Jackson County, and 4) Salem, Marion, and Polk Counties. The MAC groups will provide planning, coordination, and operational leadership and be responsible for working with landlords and unsheltered people to move them into housing stability. They will work with Oregon Housing and Community Services and the Office of Emergency Management to meet the following goals by January 10, 2024: Prevent 8,750 households from becoming homeless statewide; Add 600 low-barrier shelter beds in emergency areas; and Rehouse at least 1,200 unsheltered households in emergency areas. This work depends on the Legislature passing the governor’s proposed funding package. SB 976 - Mortgage Interest Deduction Oregon’s largest housing subsidy, the Mortgage Interest Deduction, costs the state about $1 billion per biennium in reduced revenue. Benefits primarily go to wealthier homeowners who live in urban areas. SB 976 would place limits on the deduction by prohibiting its use for second homes and reducing the amount a household can deduct based on income. The resulting increase in state revenue would be placed in a newly created Oregon Housing Opportunity Account. Resources in the account would flow through Oregon Housing and Community Services to promote affordable homeownership and prevent homelessness. Write your senators and encourage them to schedule a hearing on this common sense proposal.

ASSURE ADEQUATE REVENUE from all levels of government to provide essential services while promoting equitable and progressive tax policy. Address changes in federal taxation. Consider new revenue to fund services Oregonians need. PROTECT DEMOCRACY by protecting privacy and voting rights - including automatic registration. Fund and implement secure, efficient election software, supporting ranked choice voting. Protect against mis-, dis-, and mal-information, including from artificial intelligence. Ensure cybersecurity. Defend and support implementation of HB 4024 (2023) on campaign finance. SUPPORT HEALTHCARE/BEHAVIORAL HEALTH. Protect accessibility to all healthcare services during federal support reduction. Preserve healthcare decision rights for patients and providers. Advocate for bills that ensure that every Oregonian has access to cost-effective, clinically appropriate and affordable health care as a fundamental right. SUPPORT HOUSING STRATEGIES that keep people housed by preventing evictions and displacement, providing affordable permanent housing and support services, preserving existing low-income housing and increasing the supply of new units. Maintain shelter beds where needed. Provide state support for infrastructure and pre-development expenses for affordable housing projects. SUPPORT FUNDING FOR EDUCATION. Provide adequate & equitable funding for early childhood, child care, K-12, after-school and summer care, as well as higher education. Advocate for coordination and transparency in funding. SUPPORT NATURAL RESOURCES agencies that address water, land use and wildfire, retaining important staff expertise and data collection. Support policies that protect and enhance Oregon's land, sea and air, especially from threats from new federal government actions. ADDRESS THE CLIMATE EMERGENCY by supporting 2017-2025 Carbon/Climate Executive Orders, net zero greenhouse gas emissions before 2050 while ensuring environmental justice with a just transition for workers and impacted communities. Likely leadership will continue to focus on challenging fiscal issues, Federal Executive Branch constitutional / overreach issues affecting fiscal and policy issues and the Governor’s on-going priorities. As in previous short sessions the League plans to work independently and with our coalition partners on critical pragmatic focused legislation. But they have not shared their climate/energy priorities for the 2026 session. Key climate and energy issues New legislation in effect in fall 2025 Several energy-related bills from the 2025 session became effective in late September 2025 (91 days after the session's conclusion on June 27). Key legislation includes: Microgrids: HB 2066 directs the Oregon Public Utility Commission (PUC) to establish a regulatory framework for microgrids. Grid enhancement: HB 3336 requires electric companies to plan for the deployment of grid-enhancing technologies (GETs). Investment reporting: HB 2081, the "Climate Resilience Investment Act," requires the State Treasury to analyze and report on climate change-related risks to the public employee retirement fund (PERS). Failed or stalled initiatives During the 2025 regular session, a number of significant climate and energy proposals did not pass but could be revisited in the future. These included: "Right to a clean environment": Senate Joint Resolution (SJR 28) , a proposed constitutional amendment, failed to pass. Climate Superfund: Bills ( SB 682, SB 1187 ) that would have established a climate superfund to cover the costs of climate change did not pass. Fossil fuel divestment: A bill ( SB 681 ) to prohibit fossil fuel investments by the State Treasury failed. Future policy discussions Policymakers and advocates have already set the stage for continued climate and energy debates: Oregon Energy Strategy: The Oregon Department of Energy (ODOE) solicited public feedback in September 2025 for a new energy strategy to help the state meet its climate goals. Ongoing debates: Issues such as utility costs for large users, transportation policy, and wildfire funding were discussed in the 2025 regular session and are expected to continue in future sessions. Looking ahead The interim work in September and October 2025, including the House Committee on Climate, Energy, and Environment (CEE) meetings, helped to shape the climate and energy policy agenda for future sessions. Further interim legislative days are planned for November, 2025 and January, 2026. In addition, potentially effecting 2026 session, SCEE Committee Hearing included Invited Speakers Only , which heard presentations regarding: Washington’s Climate Commitment Act Green Banking: Maine’s Blue Economy Task Force Impacts of Federal Actions on Oregon’s Solar Industry The House CEE heard presentations on the Impacts of Recent Federal Actions on Energy and Environment-Related Agency Operations and Renewable Energy Development in Oregon. Natural and Working Lands (NWL) By Josie Koehne The Oregon Climate Action Commission (OCAC) report from the Oregon Department of Forestry on the NWL Fund was very minimal and did not include how much of the Fund ODF has been spent-- repeating what the Fund wis intended to fund and just a little on the seed banking with no financials or timeframes. In addition, the recording of the Sept 3 was without any visuals, was completely inaudible and one presentation had not been posted. The League complained to Chair Kelly and now the presentation and a better recording have been posted: https://www.youtube.com/watch?v=XVuDrjTwZew&t=8066s listen around 1:45. Oregon Climate Equity Network Meeting Sept. 4, 2025 The long session largely focused on expensive issues other than climate. New leadership was not well-positioned to meet the moment. With 4,000+ bills there was a lack of clear, unified priorities among the Democratic supermajorities. Climate advocates were on constant defense to prevent stalling and weakening of bills. A number of Key learnings: Need to cultivate champions now more than ever. Utilities still hold a lot of power, but their constant opposition works against them. Legislator reputation and abilities can make or break a bill. Committee leadership matters – see above. Governor’s input (when offered) can be decisive. One-time funding should be avoided; advocates should not come back with requests year after year. Legislative Days, Sept. 29–Oct. 1: Need to fill Amy Schlusser’s seat on the Environmental Quality Commission with a climate advocate – she now works in Gov. Kotek’s office. One more EQC seat to fill as well. The President is trying to rescind all IRA investments, which would drastically impact our state budget. The budget reconciliation act accelerates phase-out of solar/wind tax credits; rescinds unobligated funding from EPA programs; implements FIAT restrictions that complicate supply chains for renewable energy; and provides selective support for nuclear, hydrogen, clean fuels. USDA is blocking siting of solar on “prime farm land.” ODOE Energy Strategy comments were due 9/22. . Major pathways include energy efficiency (buildings and transp.), strategic electrification, clean electricity, low-carbon fuels for hard-to-decarbonize applications, resilience. Feedback and themes from the Nine Tribes focused on energy independence, affordability, decision making, funding access, and consultation. Calls for 42 near-term actions. ODOE will get major pushback from O&G and utilities. 2026 session (Feb. 2-March 9) priorities: Building Resilience: electrification of homes and buildings, managed transition off Natural Gas, resilience to climate harms. Clean Grid Collaborative: Address statewide transmission restraints, continue to work toward a state transmission authority. Governor support would be key. Move Oregon Forward: Road usage charge fix – raise rate from 20 mph to 30 mph; transit funding – remove the 2028 sunset. Cap and Invest conversation. Legislators are facing a critical vote on the transportation package, and they are already being attacked. Industry is trying to persuade them that the “easy fix” is to divert money from the Climate Protection Program . DEQ CPP President Wagner said no to moving forward SJR 28 , the right to a healthy environment amendment. Concerns are that it would trigger a GOP walkout, issues with the title of the proposed amendment. Likely no action in short session but still a target for the next long session. Recent National and State News Oregon to accelerate siting of renewable energy projects to beat Trump’s incentive deadline | OPB “Today, Governor Tina Kotek signed Executive Order 25-25 to accelerate the pace of renewable wind and solar project development in the state ...     Campaign Finance In Oregon An Oregon History of Campaign Finance Reform and the League of Women Voters Recent Campaign Finance History In 2020, the League supported the Legislature’s referred constitutional amendment Measure 107 to voters to allow campaign finance limits. Voters passed it overwhelmingly by over 78%. However, three Legislative sessions passed without implementing a Measure 107 statute. Legislators could not agree on anything that limited their own campaigns; they all are experts on financing their own campaigns and all have a huge conflict of interest. In 2022, the Honest Elections group , including the LWVOR, Common Cause and other good government groups, participated in intense negotiations with unions and Our Oregon, lasting for many months. An agreement was reached on an initiative text; however, the unions backed out of the deal at the last minute. Honest Elections redrafted the proposal together with national experts from the Campaign Legal Center, Common Cause and the League. They then filed initiative petition (IP) 9 in July, 2022, after a long drafting process where IP 8 (a constitutional amendment to stop campaign finance laws impairment), IP 23 (including Democracy Vouchers) and IP 24 (including public matching of small donations) were also filed. Honest Elections settled on IP 9 as the proposal most likely to make the ballot and be adopted by voters. After an eight month ballot title certification process all the way to the Oregon Supreme Court, while Our Oregon did its best to delay the process, the Secretary of State finally approved IP 9 for circulation in May, 2023. The campaign quickly hired petitioners, organized volunteers including the League, and eventually collected some 100,000 signatures. LWVOR policy says that the League only supports ballot measures after ballot qualification, unless it was involved in measure drafting and organizing. Then Our Oregon, sensing IP 9’s potential success, redrafted the originally agreed Honest Elections initiative text (with huge loopholes for unions and other organizations). Our Oregon filed IP 42 , got a ballot title in less than 5 months, hired circulators, and began collecting signatures in January, 2024. At this point, it was clear to some legislators entering the short legislative session, that an expensive ballot battle was brewing between IP 9 and IP 42. Very quickly and historically , some union and business lobbyists got together and drafted a legislative bill. Dexter Johnson, lead Legislative Counsel, quickly drafted an LC bill. The House Rules Committee, Chaired by Rep. Julie Fahey and Vice Chair Rep. Jeffrey Helfrich, stuffed the LC bill as an amendment into HB 4024 , an unused placeholder bill. Two hearings and a work session were quickly held within a few days. The League initially opposed the bill in its -3 amendment form. Intense negotiations ensued behind the scenes between Honest Elections, some legislators, and business and union lobbyists, with the League being supportive but not directly involved. Some 40 changes were made to the 49-page bill before Honest Elections agreed that it was “ good enough ”. Part of the agreement was withdrawal of both IP 9 and IP 42. HB 4024 initially included a referral to November ballots, also removed from the final bill. The House Rules Committee quickly passed HB 4024 to the House floor, rules were suspended, and it passed 52 to 5. The very next day, the Senate Rules Committee quickly and concurrently held a hearing and work session, passing HB 4024 to the Senate floor. The Senate suspended rules, passed the bill 22 to 6, all on the last day of session . The Governor said she would sign it. It is clear that much more work needs to be done to implement HB 4024. Funding must be allocated to the Secretary of State and administrative rules must be written and adopted before the January 2027 effective date. ORESTAR must be reprogrammed for a “dashboard”,advertising disclosure, and “drill down” to see original campaign contribution funding sources. The 2025 long legislative session will undoubtedly want to consider amendments, both good and bad. This work could continue for years, if not decades. Stay tuned! Earlier Campaign Finance History Campaign contribution limits were adopted in 1908 by initiative . Those limits remained in effect until the 1970s when the Legislature repealed them in favor of campaign spending limits, a fad at the time. In 1976, the U.S. Supreme Court struck down campaign spending limits in the famous Buckley v. Valeo court case because they violated the First Amendment. However, the SCOTUS justified contribution limits because of the state’s interest in preventing “corruption and the appearance of corruption spawned by the real or imagined coercive influence of large financial contributions on candidates' positions and on their actions if elected to office." In 1994 Oregon voters again adopted campaign contribution limits by initiative with Measure 9 . They were only in effect for the 1996 election until the Oregon Supreme Court struck them down in 1997 on the basis of free speech in the Oregon Constitution, VanNatta v. Keisling . In 1998, voters approved Measure 62 , a constitutional amendment requiring campaign finance and ad financing disclosures, and allowing the Legislature to regulate signature gathering. The Legislature later prohibited paying petition circulators per signature, among other regulations. In 2000, the League helped draft initiative Measure 6 and supported it with a Voters’ Pamphlet statement., t, to provide public funding to candidates who limited campaign spending and private contributions. It failed on the ballot. Oregon voters again passed contribution limits with initiative Measure 47 in 2006. The companion initiative, constitutional amendment Measure 46 , however, did not pass, so the Measure 47 limits never went into effect. The League did not help draft these measures and later opposed them because Measure 46 required a three-fourths (3/4) legislative vote to amend previously enacted campaign finance laws, or to pass new laws. Measure 47 also required low contributions limits, perhaps unconstitutionally. Later in 2020, when the Oregon Supreme Court rescinded its repeal of campaign contribution limits, the Oregon Attorney General and Secretary of State refused without explanation to allow Measure 47 to go into effect, even though it was still in Oregon Revised Statute. In the early 2020s, the Honest Elections group , including the LWVOR, Common Cause and several other good government groups, succeeded in getting contribution limits adopted for Portland and Multnomah County, with public funding for Portland candidates, with a small donor matching fund.

For campaign finance reform, the League wants true reform without loopholes for large special interest organizations. Redistricting People Not Politicians has started collecting signatures on IP 14 petitions downloadable from its website. Thousands of signatures have been collected, but more donations are needed. Cybersecurity and Legislative Delays By Rebecca Gladstone Sine die is technically imminent as the Speaker invoked House Rule 8.15(6) and the Senate President, Senate Rule 8.16 on May 23, a full month before the projected final session date, June 25. This reduces the 72-hour advance public hearing notice and 48 hours for all other meetings to 24-hours. It is hard to know what we can effectively influence with no news of the Senate walkout abating. We are standing by, watching carefully. Please contact your State Senator and Representative to encourage them to support these bills for cybersecurity and election software updates ( outdated software is a security risk) : HB 2490 : This cyber omnibus bill awaits second and third Senate floor readings, scheduled and subject to change. The League urges maximum protection of public health, safety, and the environment. Defending our critical infrastructures is at stake ( our testimony ). SB 167 includes election software updates. Outdated software is a cybersecurity risk. See our testimony in support, 2023 and 2019: “These aging computer programs are like the roof starting to leak. We see evidence of strain and do not want to wait further to begin remedial work from scratch in 2021” - League testimony , HB 2234 (2019). HB 2052 : This Attorney General’s Data Broker bill was assigned to W&Ms Transportation and Economic Development on May 22. League testimony in support was filed before the current -7 amendments. The bill authorizes the Department of Corrections (DOC) to enter into agreements with any community college or post-secondary academic program to offer instruction to adults in custody, as long as enrollment is consistent with DOC administrative rules and federal Pell Grant regulations. Ethics Issues By Chris Cobey HB 2038 A : Requires statement of economic interest to include certain information about sources of income for business in which public official or candidate, or member of household of public official or candidate, is officer, holds directorship or does business under if source of income has legislative or administrative interest and 10 percent or more of total gross annual income of business comes from that source of income. Prohibits candidate or principal campaign committee of candidate from expending campaign moneys for professional services rendered by certain businesses required to be listed on candidate's statement of economic interest. Creates exceptions. 5/23: House Rules work session scheduled. SB 168 B : Expressly prohibits public employees, while on job during working hours or while otherwise working in official capacity, from promoting or opposing appointment, nomination or election of public officials. 5/19: From House Rules work session 5/18; recommendation: Do Pass with amendments and be printed B-engrossed; 5/22: House second reading. SB 661 Enrolled : Prohibits any lobbyist from serving as chairperson of interim committees, or certain legislative work groups, or legislative task forces. Provides exceptions. 5/16: Passed House, 57-0-2-1; 5/18: Awaiting Governor’s signature.. Election Methods By Barbara Klein HB 2004 A (a Ranked Choice Voting bill) was scheduled for the 3 rd reading and voted on by the House members on May 23, 2023. The bill passed (35 yea, 25 nay), and was sent to the Senate. The details of the -2 amendment were summarized in the governance area of the previous LWVOR Legislative Report. The RCV coalition supporting HB 2004 A met with members and leadership of the Oregon Association of County Clerks on May 24. LWVOR took part in that meeting with praise for the clerks, and recognizing our shared interests in protecting the vote. LWVOR shared with the clerks our view that the RCV system protects the voice of voters in several ways. As Sine Die was declared imminent, and a walkout of Senate members continuing, it is unclear (but doubtful) if the bill will be voted on in this session. More input from the clerks was sought in consideration of a short-session bill early next year. Briefly discussed was the RCV initiative, IP 27 , which would expand the provisions and offices covered by the current bill above. Since our previous report, IP 26 (constitutional amendment by All Oregon Votes) received a certified title , “Amends Constitution: Changes election processes. All voters/candidates for certain partisan offices participate in same nomination procedure.” (This is similar to the certified ballot title for IP 16, which All Oregon Votes appealed to the Supreme Court, but which the Court approved without change. IP 16 is not yet listed as withdrawn. There is nothing further to report on two additional election reform ballot initiatives: IP 11 (measure on statewide STAR -Score Then Automatic Runoff voting) and IP 19 , from Oregon Election Reform Coalition (which is a Final Five Open Primary, using RCV or STAR in the general). LWVOR supports IP 19, now by way of a new League position on Open Primaries adopted by concurrence at our May 2023 convention. VOLUNTEERS NEEDED. A main funding problem concerns how the favorable ending current period balance, estimated to be >$765M, can be used. It will take a 3/5 vote in both chambers to pass this proposed change. We provided testimony on the Oregon Dept. of Energy (ODOE) budget ( HB 5016 ) and will be adding climate items to (DEQ) HB 5018 League 3/30 testimony . In both cases, our testimony will request additional agency requests not included in the Governor’s January budget. Another major issue, the upcoming mid-May Forecast, will likely provide new required budget balancing guidelines. Other CE Bills By Claudia Keith HB 2763 A updated with -1 amendment: League Testimony . Creates a State public bank Task Force. Like the RB task force, the 23-member Task Force is required to recommend no later than January 2024. “ The report must include a recommendation for a governing structure for a public bank.” This policy topic will likely have a bill in the 2024 session -1 staff measure summary . Interstate 5 (I-5) Bridge Project By Arlene Sherrett The Oregon Joint Committee on Transportation held an informational meeting on the Interstate 5 Bridge Replacement Project (IBR) on Thursday, April 13 th , 2023. The presentation, supporting testimony and questions from the committee included the urgency of the timeline for federal funding requirements to be met. Oregon’s commitment to a $1 Billion share of the costs would have to be passed through the Legislature by May 5, 2023. The League of Women Voters of Oregon has identified the Project as a key project impacting Oregonians and anyone traveling the I-5 corridor. A recording of the meeting can be viewed here . This particular meeting was for invited speakers only. Greg Johnson, Project Manager, and Kris Strickler, Director of ODOT, presented on the Project, its development, and its value to the region. SB 2098 has been drafted outlining funding and project direction but was not discussed in depth during this meeting. Other topics of concern were auxiliary lanes to be built in addition to the three existing ones each way on the current bridge and the possible impact of additional lanes to increased greenhouse gas emissions, current condition and maintenance of the bridge and its seismic readiness. The bridge is a bottleneck to west coast freight traffic, an important economic factor for the region. Legislators were concerned about the costs, the urgency to qualify for federal funding and giving airtime to other visions for the design of the bridge to make sure the investment covers all the needs of the region. The next informational meeting was scheduled on Thursday, April 20, 2023, at 5:30 PM, with a caution to look for possible date and time changes at the last minute. Public hearing on the bill was scheduled for April 27 th , 2023. Oregon Economic Analysis By Claudia Keith The Oregon Economic and Revenue Forecast was released Feb 22. The next forecast is due May 17. JW&M recommended budget will use the May forecast to balance the budget. The Oregon Office of Economic Analysis has continued to ignore the recommended SEC Climate Risk disclosure proposed rule. The Governor still has to decide if she’s signing the legislation. And the work is not done. There was not enough revenue to fund the 2025-27 budget without cuts and new legislation as shared below. The Feb. 4 Revenue Forecast guided the spending for the 2026 legislative session. Carl Ricidonna, Oregon’s State Economist, provided his report, along with Michael Kennedy, Senior Economist. LWVOR participated with several other volunteer and non-profit organizations in the unofficial Oregon Revenue Coalition that worked together to find ways to preserve Oregon revenue in the light of lost federal income from Congress’s passage of H.R.1 which would cut major sources of funding for Medicaid, SNAP and many other services. We focused on a bill to limit the damage caused by Oregon’s rolling connection to federal income tax law, since legislation to disconnect from the federal law failed in the 2025 long session. Due to this complicated tax policy, parties agreed to use the interim to consider impacts on this federal tax policy on Oregon revenue. Passed the House floor (32/26/2). On to the Senate floor at adjournment. Business interests want to have this conversation behind closed doors rather than an open public Task Force. The bill died but the conversation will continue. SB 1511 : A bill modifying the estate tax that would have increased the $1 million exemption to the estate tax to $2.5 million failed this session. The tax rates would have been greatly increased for the highest valued estates but fewer estates would pay an estate tax. For the first biennium, the revenue would have been about the same as our current estate tax SB 1511 . The revenue staff provided this analysis on the A -3 amendment that was approved by the Senate) with no expected revenue loss for this biennium, but $35 million by 2029-31. The bill did not pass out of House Revenue by end of session, but may be back in the long session. Two bills focused on increasing tax incentives for economic development faced intense debate and scrutiny, and one , SB 1586 , was withdrawn on March 3 due to much public outcry about tax breaks for data centers and the expansion of the Metro’s Urban Growth Boundary into land zoned as rural agricultural land, in violation of the 2014 Grand Bargain. OPB provided an article on this contentious bill. LWVOR testimony in opposition to the bill and additional testimony opposing the -7 amendment . The bill remained in Senate Finance and Revenue at the end of session, but is likely back in some form in 2027. The other economic development bill, HB 4084 A introduced by Governor Kotek, would fast track the permitting process for certain new business development t o be completed within 120 days, by means of a specially appointed Joint Permitting Council to oversee the each permitting agency’s permitting process. This section of the bill aligns with a federal program: Permitting Council’s FAST-41 Assistance for States. In addition, in the bill as introduced, all local property taxes abatements for Enterprise Zones were to be extended. This bill was also controversial because of these extensions since it would allow data centers which are hotly contested throughout the US, and which are the primary recipients of these tax credits, to not pay local property taxes for many years. After several amendments, three were incorporated into the final bill. LWVOR comments . The final bill included these provisions as summarized by LRO: Removes the $40 million General Fund appropriation to OBDD for deposit into the Industrial Site Loan Fund. (However, HB 5204 included $10 million for the Regional Infrastructure Fund, $5 million to support horse racing events at county fairgrounds, $5 million cash and $10 million bonds into the Industrial Site Loan Fund, and $10 million in lottery bond funds. The bonding bill provided targeted investments in sewer and water projects statewide to help with increased housing development demands.) Modifies SB 1507 (2026) to limit the tax credit for job creation to certain specified qualified industries. To qualify for the tax credit, a taxpayer must receive an attestation-based certification from Business Oregon, who will develop the tax credit application process, establish job creation determination methodology, and further define the term “qualified industry” through rulemaking. Excludes any qualified property of an authorized business in an enterprise zone with an operating data center from entering into a written agreement with the enterprise zone sponsor to 1) extend the period during which the qualified property is exempt from taxation beyond the allowable three years; 2) agree to flexible hiring timelines; and 3) approve alternative performance criteria. Prohibits data center properties from authorization as an eligible business firm prior to 90 days after the adjournment of the 2027 legislative session. An amendment was added at the end that puts this one-year moratorium on all new data center development certifications by Business Oregon, starting three months after the close of session. This allows the Governor’s Oregon Data Center Advisory Committee time to consider the various impacts of data center development on Oregon, and to report back to the Legislature with their recommendations. It also limits the existing Standard Enterprise (for urban areas) tax break to three years, but allows all other currently operating data centers, including those in rural areas of the state, to continue to receive tax breaks through the extended time periods as outlined in the bill. Oregon data center operators will save nearly a half-billion dollars in local property taxes this year through three different incentive programs. Kotek’s legislation, House Bill 4084 , would expand the fastest growing of those three programs. HB 4148 : Allows city and county services for which net local transient lodging tax revenue may be used to be provided either directly by the city or county or indirectly by a special district. The -7 amendment adopted that changes the percentage to 50/50 and passed the House floor Feb. 25 (40/12/4/4). Mar. 5 Passed the Senate (23/6/1). SJR 201 : Kicker Reform: Proposed an amendment to the Oregon Constitution to require a portion of surplus revenue that would otherwise be returned to personal income taxpayers to be used for funding public kindergarten through grade 12 education, community colleges and wildfire prevention and suppression, if surplus revenue exceeds a certain threshold. OPB covered a story about the bill . T he League has long supported kicker reform but we also note that, with our new state economist, another kicker is not expected in the near term. The bill did not get a Work Session. HB 4136 : Disallows, for purposes of personal income taxation, a mortgage interest deduction for a residence other than the taxpayer’s principal residence , unless the taxpayer sells the residence or actively markets the residence for sale. The bill had one public hearing on Feb. 16 and died in committee. The League is hopeful that a version of this bill will return in 2027. HB 4125 : Prescribes methodology for the preparation of revenue estimates used in the budgeting process and as applicable to the surplus revenue refund process — potential kicker reform. Public Hearing Feb. 2. The bill died in Committee . On Feb. 20, the US Supreme Court declared that President Trump does not have authority to impose widespread tariffs under a specific federal statute. Oregon’s Attorney General, Dan Rayfield, led the coalition of states arguing that the President did not have this authority. HB 4061 B passed that provides monies to help Oregon businesses hurt by these tariffs. Budget Report . The bill passed the House on Mar. 3 and passed the Senate Mar. 6. On Thursday Mar. 5, Rayfield and officials from 23 other states filed a lawsuit against the new tariff at the U.S. Court of International Trade, with Oregon again leading the way. “Budget aftershocks from the Trump cuts to Medicaid and SNAP will keep hitting Oregon in future years,” said Senator Jama. “Oregon lawmakers must continue working together to make resources stretch and to help families thrive.” As we await the May 20th Revenue Forecast, we watch for data that may change the forecast. Oregonlive reports that Oregon exports are down. Then we now have a war with Iran that, so far, has increased gas and diesel prices. That increases costs to state agencies, local governments, Oregon businesses and individuals. Iran, Saudi Arabia, Qatar, the United Arab Emirates and Bahrain — supply more than a third of the world’s urea, an important nitrogen fertilizer, and nearly a quarter of another one, ammonia. And they all use the Strait of Hormuz to export their products. So that means less food production and an increase in food prices. The February national jobs report was not good (loss of almost 100,000 jobs) and the national unemployment rate rose to 4.4%. (In Oregon, we’re at 5.2%.) As we watch the U.S. and Oregon’s economy, we note the Oregon Capital Chronicle Jobs Report article , of special concern as Oregon is an income tax state. According to this Oregonlive article , Oregonians are working the fewest hours since 2010. Oregon workers are spending less time on the job, another indication that the state’s labor market continues to sag. The average Oregonian worked less than 33 hours a week in December, according to federal data. That’s the lowest number since 2010, when the state was still digging out from the Great Recession — even worse than the sharp decline that accompanied the pandemic. As we continue to be concerned about the economy, we note a study related to AI: Brookings Institution study on AI job losses and adaptability points out metros most at risk – Portland Business Journal Roughly 30% of workers displaced by artificial intelligence will struggle to find new jobs, according to a new report from the National Bureau of Economic Research and Brookings Institution. While 70% of highly AI-exposed workers would likely be able to transition to another job, the rest may have trouble adapting “due to limited savings, advanced age, scarce local opportunities, and/or narrow skill sets. ”What’s more, of the displaced workers in low-adaptive jobs, 86% are women. The League will continue to work with the Oregon Revenue Coalition and others as we address the need for increased revenue to pay for the services Oregonians need. The Ways and Means Co-Chairs warn of increased demand and federal funding cuts for the 2027-29 and 2029-31 biennia. It's time to work with state agencies as they develop their 2027-29 budgets. On Thursday Mar. 5, Rayfield and officials from 23 other states filed a lawsuit against the new tariff at the U.S. Court of International Trade, with Oregon again leading the way. “Budget aftershocks from the Trump cuts to Medicaid and SNAP will keep hitting Oregon in future years,” said Senator Jama. “Oregon lawmakers must continue working together to make resources stretch and to help families thrive.” As we await the May 20th Revenue Forecast, we watch for data that may change the forecast. Oregonlive reports that Oregon exports are down. Then we now have a war with Iran that, so far, has increased gas and diesel prices. That increases costs to state agencies, local governments, Oregon businesses and individuals. Iran, Saudi Arabia, Qatar, the United Arab Emirates and Bahrain — supply more than a third of the world’s urea, an important nitrogen fertilizer, and nearly a quarter of another one, ammonia. And they all use the Strait of Hormuz to export their products. So that means less food production and an increase in food prices. The February national jobs report was not good (loss of almost 100,000 jobs) and the national unemployment rate rose to 4.4%. (In Oregon, we’re at 5.2%.) As we watch the U.S. and Oregon’s economy, we note the Oregon Capital Chronicle Jobs Report article , of special concern as Oregon is an income tax state. According to this Oregonlive article , Oregonians are working the fewest hours since 2010. Oregon workers are spending less time on the job, another indication that the state’s labor market continues to sag. The average Oregonian worked less than 33 hours a week in December, according to federal data. That’s the lowest number since 2010, when the state was still digging out from the Great Recession — even worse than the sharp decline that accompanied the pandemic. As we continue to be concerned about the economy, we note a study related to AI: Brookings Institution study on AI job losses and adaptability points out metros most at risk – Portland Business Journal Roughly 30% of workers displaced by artificial intelligence will struggle to find new jobs, according to a new report from the National Bureau of Economic Research and Brookings Institution. While 70% of highly AI-exposed workers would likely be able to transition to another job, the rest may have trouble adapting “due to limited savings, advanced age, scarce local opportunities, and/or narrow skill sets. ”What’s more, of the displaced workers in low-adaptive jobs, 86% are women. The League will continue to work with the Oregon Revenue Coalition and others as we address the need for increased revenue to pay for the services Oregonians need. The Ways and Means Co-Chairs warn of increased demand and federal funding cuts for the 2027-29 and 2029-31 biennia. It's time to work with state agencies as they develop their 2027-29 budgets. Here’s some budget guidance that agencies have received: 2027-29 Budget Guidance: Governor's Letter and CFO 2027-29 Budget POP Guidance . Bottom line: The Governor has asked state agencies to provide a “neutral” budget. If they want to add a program or staff, they need to find a program or staff to remove from their budget request. You can contact the agency you want to engage with as they work to provide proposals to the Governor around June. Two placeholder bills on studying utilities have been filed, Senate Bill 128 and House Bill 3158 , and Rep. Pam Marsh, D-Ashland, is working on another one.“ (see SB 553 (LC 1547) mentioned below) Transportation package that prioritizes climate, equity, and wildlife : This package would build on the historic gains of HB 2017 (which included investments in public transit, safe routes to School, and vehicle electrification), to shift the focus to multimodal, safety, and climate-forward investments. The Electronic Portal Advisory Board (EPAB) met in November, 2023, highlighting the Oregon Digital Equity Plan draft; see consolidated documents . Expect several Artificial Intelligence (AI) bills this session. In mid-November, Sen. Woods’ staff asked us to work on an elections AI bill (LC 132), paraphrasing highlights here: AI means digital technology used to create an image, audio or video recording of an individual’s appearance, speech or conduct that a reasonable person would believe depicts a real individual but that did not actually occur. The bill requires disclosing any form of AI use in campaign ads and communication. A filing officer believing an election law or rule violation has occurred shall proceed promptly as though they had received a complaint. Time periods in the bill range from 3 days to 5 years. Circuit courts are directed to prioritize these restraining orders, prohibitions, or injunctions, which may be issued without proof of injury or damage to any person. Civil penalty enforcement is not to exceed $10,000. Being effective on passage could impact Oregon 2024 campaigns. Notwithstanding ORS 260.005 (10)(c)(B)(i), a campaign communication may involve aggregate expenditures of any amount. Forecast ’24: Privacy and broadband access are ongoing concerns for 2024 legislative sessions, but breakthroughs in artificial intelligence are outpacing lawmakers’ ability to respond. It’s just hard to think that way, in parallel.” Election Methods By Barbara Klein On 1/11/24 the Joint Committee On Ballot Measure Titles and Explanatory Statements held a work session and public hearing on HB 2004 (a Ranked Choice Voting bill from 2023 that the LWVOR supports). Currently it is known as Legislative Concept 60 (LC 60). See LWVOR testimony . This same committee is preparing ballot titles for two other legislative referrals: ( LC 59 ) would set up a process for the Oregon House of Representatives to impeach statewide elected public officials and for the Senate to convict impeached officials. ( LC 58 ) would create a commission to determine the salaries of state level public officials. Campaign Finance and Redistricting LWVOR has endorsed circulating petitions. They can be downloaded, printed, signed and returned by mail from Honest Elections for IP 9, Campaign Finance Reform, and People Not Politicians for IP 14, Redistricting. Initiative petition signature filing is due July 5, 2024. Watch for legal status updates.

Redistricting By Chris Cobey and Norman Turrill The People Not Politicians coalition, in which the LWV of Oregon is a leader, now has an office in Wilsonville and a campaign manager. It will circulate only IP 14 (only legislative redistricting) and will begin collecting petition signatures probably in February. Four bills related to redistricting have been filed in the Legislature, detailed in a previous LR. Elections By Tom Messenger SB 804 by Senator Manning emerged as a companion to SB 499 by Senator Weber to move the Presidential Primary to Super Tuesday. Rights of Incarcerated People By Marge Easley On January 30, the League delivered testimony in Senate Judiciary in strong support of SB 579, which would restore the right to vote to over 13,000 people in Oregon’s prisons and jails. The response to the many individuals who delivered persuasive testimony was heartening, as was the fact that a work session on the bill was scheduled for February 2. However, instead of a work session the bill was sent to Ways and Means, which means it may or may not resurface later in the session. The League has added our name to the Guaranteeing the Right to Vote’s endorsement list for the bill, and we will continue to work for its passage. Public Records Law By Rebecca Gladstone The League positions balance privacy and transparency needs. At an Oregon Public Records Advisory Council (PRAC) meeting last fall, we heard that a public records request denial might be considered in the public interest if it presents a conflict of interest for workload. We will be evaluating as the SoS budgets ask for increased staffing in response to this. We have always supported Elections Division staffing budget requests, based on services, not on defense from efforts “to complicate or undermine their work.” Last fall, as Oregon hit 3 million registered voters , Oregon election offices got unprecedented numbers of public records requests , mirrored nationally. Last week, the PRAC shared a wide-ranging roster of 33 proposed bills affecting public records law . Some, for example, may affect elections and League Vote411.org access to candidate and ballot measure filing information. We will be watching these for relevant League action, in some cases addressed in previous session versions. Extensive 2017 public records law work passed with our support: SB 2101 for exemptions ( our testimony ), SB 481 for public records access policy (our testimony ), and SB 106 for a Public Records Advocate and Council ( our testimony ).
