Jean was introduced to the League in 2008 after she retired as a Professor of Educational Psychology at Northern Illinois University. Her first experience was serving on the national League’s study committee which developed the Federal Role in Public Education position. She headed the equity part of the study. After that experience, she joined the LWV of Illinois Issues and Advocacy Committee, which she chaired from 2014-2023. In 2023 she moved to Oregon, joining the Washington County Unit and the LWVOR Action Committee. Currently, Jean serves as Chair of the Action Committee for the state League. She is the Coordinator of Social Policy, with a focus on Education issues. Born and raised in Grants Pass, Oregon, civic engagement runs deep for Evan. He was raised by a nurse and a teacher, whose guidance strongly shaped his life trajectory. His parents’ strong support for democracy and the rule of law was part of daily life during his upbringing. These values stuck with him, leading to involvement in multiple political movements in Grants Pass. After graduating from Grants Pass High School in 2022, Evan began studying Political Science and Legal Studies at the University of Oregon. He has been heavily involved in the University through the Young Democratic Socialists of America Club, Oregon Pit Crew, and Students for Justice in Palestine. In Spring 2023, Evan was selected to attend the Oxford Consortium for Human Rights at Oxford University, studying human rights from leading activists and scholars in the field. In his second year he began working as the Civic Engagement Program Assistant for the Holden Center for Leadership and Community Engagement, where he develops and facilitates civic discussions, and registers students to vote. Evan began his involvement with the League of Women Voters of Oregon in 2023, where he was a co-founder of the League’s Youth Council, taking on the role of the Youth Voter Strategist, where he aided in the development of outreach strategies to keep youth civically engaged. In 2024, he was elected as the President of the Youth Council, and became a Board Director for the state League. Ways and Means Subcommittees can’t begin hearing agency budgets since agencies have to follow the Governor’s requests. Her budget needs to be “balanced” with the revenues forecasted back on November 16 unless she proposes additional revenue. BUDGETS/REVENUE Want to know how the legislative budget process works? COASTAL ISSUES By Christine Moffitt Coos County, City of Coos Bay, and City of North Bend have been working on updates to the Coos Bay Estuary Management Plan (CBEMP). The County file number assigned to this project is AM-22-005 . Here is a link to the LWV Coos Study and meeting s and a link to a memo by League member Moffitt. At this time, LWV Coos is asking stakeholder agencies to review the Draft Coos Bay Estuary Management Plan (Parts 1 and 2) and the Coos Estuary Map Atlas for concurrence with the agency’s requirements and interests. Comments submitted by February 20, 2023 will be addressed as possible in the document draft submitted for the post-acknowledgement plan amendment process to DLCD on March 1. Comments outside of the current work scope, including comments associated with a Full Plan revision, are welcome. These comments will be included in the packet provided to staff as part of the final draft. Agenda . ELLIOTT STATE RESEARCH FOREST By Peggy Lynch On Jan. 20, the Oregon State University (OSU) Board of Trustees received a presentation on the projectstatus and OSU’s work. The Board will need to formally approve OSU’s participation in the next few months. The Forest will become a separate public entity on July 1 with its own Board of Directors. LAND USE/HOUSING By Peggy Lynch On Jan. 23 Senate Housing and Development received a presentation on System Development Charges—used to pay for infrastructure needed for new development. LWVOR supports state help for these charges for low-income and even middle income (up to 80% AMI) developments. Duncan Wyse, Oregon Business Council, shared with the Joint Committee on Semiconductors that Oregon needs to set aside two parcels of land that are at least 500 acres and ready for development by a semiconductor manufacturer, as well as several smaller plots of land for similar purposes. A legislator pointed out the need for land for more housing if new manufacturing plants are built. KGW provided good meeting coverage . The League wants to remind legislators that Washington County’s prime agricultural land is also an industrial land usage and cannot be replaced! HB 2899 : Building on wetlands is cost prohibitive—and from the League’s view should not be allowed. This bill removes certain lands from definitions of buildable lands for purposes of urbanization, including floodways, wetlands, and special flood hazard areas. This ensures that the state has a more accurate calculation of buildable lands. The League will be watching this bill. We support the concept, but have concerns about implementation. HB 2203 : Allows RVs used to provide security of farm use to be sited on lands zoned for EFU. Public Hearing was held on 1/19. LWVOR has concerns around waste disposal, drinking water availability and other services. However, the testimony focused on the ability of forestry to use this provision in law so the agricultural industry should be able to do the same. HB 2889 : Establishes Oregon Housing Needs Analysis within the Housing and Community Services Department. LWVOR supports. TOXICS By Paula Grisafi HB 3043 LWVOR joined others in support of the Toxic Free Kids Act Modernization bill. Thousands of chemicals lurk in products our kids use every day, and children are far more vulnerable to toxic chemicals than adults. And parents should not have to be expert chemists or have to shop in specialty stores in order to obtain safer products. Read LWVOR testimony . WATER By Peggy Lynch According to the US Drought Monitor, nearly 64% of Oregon is experiencing moderate (D1) to exceptional (D4) drought conditions. Changes over recent weeks include a number of improvements and degradations. Reservoir storage contents in most U.S. Bureau of Reclamation (including Klamath) projects are measuring well below average, with many showing similarities to the past couple water years. The League is reviewing HB 3100 , a bill that updates requirements for the Integrated Water Resources Strategy (IWRS). Section 1 of the bill has many positive additions, but Section 2 requires yet another standing Advisory Committee. Committees take staff time and resources and the Water Resources Commission provides adequate oversight. We’ll listen to others as we consider testimony on this bill, but we wholeheartedly support the guidance of the IWRS as it links multiple water agencies towards “abundant clean water for all”. We all need to pay attention to the potential for harmful algal blooms. “When in doubt, stay out.” V isit the Harmful Algae Bloom website or call the Oregon Public Health Division toll-free information line, 877-290-6767, to learn if an advisory has been issued or lifted for a specific water body. We have an on-going drought throughout Oregon and League members may want to check the U.S. Drought Monitor , a map that is updated every Thursday. WILDFIRE By Carolyn Mayers The League monitored the Senate Committee on Natural Resources January 18th meeting with an update on SB 762 (2021). Meeting summary can be found here . Meeting materials, including detailed reports may be found here . “ We no longer have a fire season. We have a fire year.” Mark Bennett, Chair, Wildfire Programs Advisory Council. An update on the progress of the Wildfire Programs Advisory Council was presented by Chair Bennett. Highlights included a summary of work completed in 2022, and a statement that future work will include increased emphasis on Community Wildfire Risk Reduction. Homeowners’ cultural traits should be considered when promoting wildfire mitigation efforts, OSU study finds: About one-third of housing in the lower 48 states of the U.S. now lies in the wildland-urban interface, where they are more susceptible to wildfires, prior research has found. A survey answers: Should Oregonians be allowed to build homes in areas of high and extreme risk? Jan. 25 th News Update on the Wildfire Exposure (Risk) Map—a postponement. HB 2898 : A wildfire recovery bill that continues the allowance that recreational vehicles may remain on a lot with a single-family dwelling that was damaged by natural disaster. It extends this allowance until December 30, 2030 for dwellings destroyed in 2020 wildfires. The League has concerns about wastewater and other services that are needed and that this bill might perpetuate these vehicles where long term housing should exist. The State of Oregon and many Oregon jurisdictions are not aligned with 2023 IPCC goals nor ‘Juliana vs U.S.‘ return to 350 ppm C02 by 2100 ; and or by 2100 limiting warming to 1.5-degree Celsius. Environmental Justice SB 907 A ‘Right to Refuse Dangerous work’ was signed by the Governor on June 7. Other CE Bills HB 2763 A Creates a State Public Bank Task Force, League Testimony . For campaign finance reform, the League wants true reform without loopholes for large special interest organizations. Redistricting People Not Politicians has started collecting signatures on IP 14 petitions downloadable from its website. Thousands of signatures have been collected, but more donations are needed. Cybersecurity and Legislative Delays By Rebecca Gladstone Oregon’s Cybersecurity put at risk by Senate walkout This is on the annual sine die t-shirt, “Sine Die 2023 It’s Hammer Time at the Capitol”: Hopes for breaking the Senate walkout logjam seem slim, now in the sixth week. The singular focus on HB 2002 is likely to kill many critical bills as processing time vanishes, including critical cybersecurity bills carried over from 2022. Delaying cybersecurity action is already exacting high prices for Oregon, asking for more trouble. Meanwhile, some bills are moving through W&Ms on short notice. SB 166 A addresses some privacy and harassment concerns, amended with a proposed cash “physical currency” annual aggregate limit of $100 for campaign contributions, to directly address some dark money concerns. This is the biennial Secretary of State bill to correct various election laws issues, supposed to be non-controversial. It passed the House on June 1 with no votes against. See our March 14 testimony and previous extensive reports, predating amendments. Sitting in W&Ms: HB 2049 A : This cybersecurity omnibus bill is now assigned to W&Ms Sub Education, referred March 3 Do-Pass with amendments, A-Engrossed. See our testimony in support. HB 2052 A : This AG Data Broker bill is now in the full W&M awaiting a work session. League testimony in support was filed before current -7 amendments. SB 510 Enrolled , for Public Records Advocate and Council funding, awaits the Governor’s signature. LC 47 requires all notary public applicants to complete a course of study. LC 251 requires the Governor to fill a vacancy in the office of U.S. Senator by appointment within 30 days until a special election can fill the vacancy. The Electronic Portal Advisory Board (EPAB) met in November, 2023, highlighting the Oregon Digital Equity Plan draft; see consolidated documents . Expect several Artificial Intelligence (AI) bills this session. In mid-November, Sen. Woods’ staff asked us to work on an elections AI bill (LC 132), paraphrasing highlights here: AI means digital technology used to create an image, audio or video recording of an individual’s appearance, speech or conduct that a reasonable person would believe depicts a real individual but that did not actually occur. The bill requires disclosing any form of AI use in campaign ads and communication. A filing officer believing an election law or rule violation has occurred shall proceed promptly as though they had received a complaint. Time periods in the bill range from 3 days to 5 years. Circuit courts are directed to prioritize these restraining orders, prohibitions, or injunctions, which may be issued without proof of injury or damage to any person. Civil penalty enforcement is not to exceed $10,000. Being effective on passage could impact Oregon 2024 campaigns. Notwithstanding ORS 260.005 (10)(c)(B)(i), a campaign communication may involve aggregate expenditures of any amount. Sean McSpaden, for renaming our HB 2049 group to the AI group, sending ongoing reading, some here: Governor’s Kotek’s Executive Order (EO-23-26) – to establish a State Government AI Advisory Council. News Release (November 29, 2023) Racing to Keep Up: Consumer Data Privacy and AI Advancements , National Conference of State Legislatures (NCSL) (November 28, 2023). Forecast ’24: Privacy and broadband access are ongoing concerns for 2024 legislative sessions, but breakthroughs in artificial intelligence are outpacing lawmakers’ ability to respond. NCSL Artificial Intelligence 2023 Legislation (Updated September 27, 2023). In 2023 legislative sessions, at least 25 states, Puerto Rico and DC introduced AI bills, and 15 states and Puerto Rico adopted resolutions or enacted legislation. NCSL Artificial Intelligence (AI) in Elections and Campaigns – November 7, 2023. AI Background: Sen. Woods notes that AI is not new, cites Alan Turing, “the Father of AI,” and the 1950 Turing Test, to test a machine’s ability to convincingly carry-on human conversation. From The Guardian, Dec 7, 2023, Eliza, a 1960s computer program, beat the viral AI chatbot ChatGPT at the Turing test, designed to differentiate humans from artificial intelligence, by 27% to 14%. But OpenAI’s GPT-4 chatbot tricked study subjects more than Eliza did, succeeding 41% of the time. AI’s vast AI scope See the Dec 4, 2023 New Yorker on the AI Revolution: Human beings “think linearly. You give instructions to someone on how to get from here to Starbucks, and you give them individual steps,” he said. “You don’t give them instructions on how to get to any Starbucks location from anywhere. It’s just hard to think that way, in parallel.” Election Methods By Barbara Klein On 1/11/24 the Joint Committee On Ballot Measure Titles and Explanatory Statements held a work session and public hearing on HB 2004 (a Ranked Choice Voting bill from 2023 that the LWVOR supports). Currently it is known as Legislative Concept 60 (LC 60). See LWVOR testimony . This same committee is preparing ballot titles for two other legislative referrals: ( LC 59 ) would set up a process for the Oregon House of Representatives to impeach statewide elected public officials and for the Senate to convict impeached officials. ( LC 58 ) would create a commission to determine the salaries of state level public officials. Campaign Finance and Redistricting LWVOR has endorsed circulating petitions. They can be downloaded, printed, signed and returned by mail from Honest Elections for IP 9, Campaign Finance Reform, and People Not Politicians for IP 14, Redistricting. The League was pleased with the breadth of programs funded as well as the policy bills that were also funded. But there were disappointments, too. Scan the amended bill for items of interest to you. Included in the amendments were eleven budget notes : instructions to agencies to collaborate on projects, to report back on how monies were spent and to study issues such as how to fund wildfire programs. HB 5201 and HB 5202 are the bonding bills and were amended as well. F ees adopted by state agencies since the 2025 session were approved in SB 5702 . SB 1501 was the “program change bill”, used to address miscellaneous changes to agency programs. The agency budget process for 2025-27 is beginning. Look for presentations to agency Boards and Commissions soon. Quarterly revenue forecasts will be provided on May 29 and August 28. Then the November 20 th forecast will be the basis of the Governor’s Recommended Budget to be presented on December 1 st. Coastal Issues By Christine Moffitt/Peggy Lynch HB 5201 as amended in Section 5 (2) increases the uses of the bond monies that have been deposited in the Oregon Business Development Department Coos Bay Channel Fund in previous sessions not only to “deepen and widen the Coos Bay Federal Navigation Channel” but also “for the design, engineering, permitting and land acquisition efforts related to the Pacific Coast Intermodal Port project.“ Oregon has a pilot mapping tool to better understand carbon storage in Oregon estuaries, in hope of s upporting long-term goals to preserve them. Dept. of State Lands (DSL) By Peggy Lynch DSL has a new website: Oregon.gov/DSL The Bureau of Land Management (BLM) is working with DSL to identify In Lieu lands (part of the 1,400 acres of land still owed Oregon on statehood). Click here to view the BLM Proposed Classification Decision , and a public notice that two forestland properties in Linn County have been identified for some of those In Lieu lands. Learn more . Elliott State Research Forest (ESRF) By Peggy Lynch Work is continuing on eventual adoption of a Habitat Conservation Plan and a Forest Management Plan for ESRF. Visit DSL's Elliott webpage to learn more . A recommendation with structural governance may be before the State Land Board on April 9. If approved, look for appointments to the new ESRF Board at their June 11 tth meeting. The $4 million that had been allocated to the ESRF Authority was transferred to DSL in the omnibus budget bill, SB 5701. Forestry (ODF) By Josie Koehne The Board of Forestry met March 6 and 7. State Forester Cal Mukumoto has recommended staying the course on the Habitat Conservation Plan per Board packet .pages 116-118. On Thursday, March 7, State Forester Cal Mukumoto proposed passage of the recommended state Western Habitation Conservation Plan (HCP). Everyone acknowledged the great amount of passionate public testimony that has already been heard on both sides - in support and in opposition - to the plan over the past five years. Public comments were made about the harm that will be done to the logging community with less timber harvest on western state forest land and stated that more mills will close. Arguments in support centered on the necessity to meet the federal requirement to preserve habitat for endangered species and avoid potential lawsuits. Delay in starting over (up to 4 years) and evaluating other HCP options will further endanger protected species and other wildlife. You can watch the meeting and read more in this OPB article . Part of the challenge in making this decision is that certain western Oregon counties and local jurisdictions have relied on the timber harvest income and have not increased their local property taxes or found other economic development opportunities to plan for this income loss. There have been discussions at the legislature around how to increase that revenue ever since the severance tax was eliminated, leaving only the Forest Products Harvest Tax and greatly reducing harvest revenue. We can expect this discussion to continue in 2025. There are a number of bills this session around funding ODF and fighting wildfire with some bills increasing timber harvest revenue without increasing the actual harvest. For information on the various bills, s ee the Wildfire section of this report below. Land Use & Housing By Peggy Lynch The Climate Friendly and Equitable Communities rules adopted by the Land Conservation and Development Commission were appealed to the Oregon Court of Appeals and a ruling was handed down on March 6 th . Most elements of the rules were upheld. HB 4026 passed and is awaiting the Governor’s signature. The bill determines that urban growth boundary decisions cannot be voted on and are “administrative” in nature. The bill is retroactive, so the measure will stop a vote in North Plains this May, although we expect that it is possible this legislation may be challenged in court. The “relating to elections” clause of the bill allowed the legislature to “gut and stuff” the bill with this provision. The League provided testimony and is concerned that “ the amendment would take away voters’ rights to the referendum process. Furthermore, changing the constitutional referendum process and making the amendment retroactive are likely to be unconstitutional and invite a lawsuit. “ The Citizen Involvement Advisory Committee is recruiting for a new member from Oregon’s Third Congressional District. Applications are due by March 18, 9 a.m. Follow the work of the Oregon Housing Needs Analysis (OHNA) Rulemaking Committee on the department’s Housing Rulemaking webpage . Reduce/Recycle By Camille Freitag The League weighed in again this year on a Right to Repair bill, SB 1596 . We also joined others in support of the bill. The bill passed both chambers and is awaiting the Governor’s signature. DEQ is conducting rulemaking to clarify and implement HB 3220 (2023) , which updates and makes necessary changes to the statewide electronics recycling program, Oregon E-Cycles. To learn more about this rulemaking and the advisory committee please visit the Oregon E-Cycles rulemaking web page . The meeting agenda and materials for the sixth Recycling Modernization Act Rulemaking Advisory Committee has been posted on the Recycling 2024 website. The meeting will be held 9 a.m. to 1 p.m., March 14. To attend please Register via Zoom . DEQ staff will be providing updates about previously- presented rule concepts and will be introducing new topics about: defining limited-sort facilities, commingled materials and reload facilities, outbound contamination rates and certification for out-of-state commingled recycling processing facilities. Water By Peggy Lynch The Oregon Water Resources Dept. (OWRD) announced that the draft of Oregon’s Integrated Water Resources Strategy (IWRS) is accepting initial public review and comment, March 5 through April 5. An updated draft is then anticipated to be available for a second public comment opportunity in May. The Oregon Water Resources Commission will hear public testimony and consider adoption of the 2024 IWRS at their September meeting. For more information about this process, please visit the IWRS page on their website. The League hopes members will engage since we were actively engaged in the original legislation and in the 2012 and 2017 IWRS documents. This new draft takes an entirely new slant from the current IWRS. It will be important that the original documents not be invalidated but instead enhanced by this proposal. OWRD has announced revised groundwater allocation rules . The department is providing multiple opportunities to engage. OWRD will be hosting informational sessions before each public hearing where staff will review the proposed rules. Public comments will not be accepted at the information sessions but will be accepted at the public hearings following each session . The omnibus budget bill, SB 5701, included an allocation of $1 million General Fund added to the Water Well Abandonment, Repair and Replacement Fund . The League was engaged in helping create this fund in 2021 and supports this allocation. Wildfire By Carolyn Mayers Things have wound down for the 2024 Short Session of the Legislature, during which hopes for a solution to the lack of sustainable funding for wildfire programs were officially dashed. The League continued following Representative Marsh/Senator Steiner’s HB 4133 , the last of the three bills which attempted to address the wildfire funding issue. It had been scheduled for a Work Session before the Joint Subcommittee on Capital Construction, but was pulled at the 11th hour due to a technical issue with the funding structure, and is dead. The Capital Chronicle published this article on March 7, with a summary of the fates of most of the wildfire-related bills, including the other two funding bills which had already failed. OPB also covered this story. For the Oregon Dept. of Forestry, a major issue is cash flow since, when they fight fires, the money for contractors goes out, but reimbursement from FEMA and others often takes months or years. Some other wildfire-related bills succeeded. Representative Marsh’s Prescribed Fire Liability and Home Hardening Grant Program bill passed. Also, two bills which address taxes on wildfire victims both passed. The first, SB 1520 , allows wildfire victims to take income tax subtractions for settlements and judgements related to wildfire damages, as well as attorneys’ fees. SB 1545 allows counties to offer a property tax break to wildfire victims who rebuild their homes. Among highlights in SB5701 , the Budget Reconciliation Bill, $8 million was allocated for the Department of the State Fire Marshal to support prepositioning, readiness response, and cash flow constraints for the 2024 fire season. Also, a Budget Note was included, which directs the Oregon Department of Forestry (ODF) and the Department of the State Fire Marshal to convene a facilitated workgroup to collaborative on finding sustainable wildfire funding solutions with stakeholders representing a broad swath of interests, in a clear recognition that this remains a high-priority, difficult issue. The money ODF received was really a fund shift, so there is $10 million from the General Fund for landscape resilience, but it was just money allocated in 2023 that had been placed in a different fund. SB 1552 , Sections 40-42, allocated $300, 000 for a study of forestry workforce. Advocated by the Association of Oregon Loggers, the study is to be inclusive of many groups, including youth groups, currently involved in workforce training and forestry experiences. In communities throughout Oregon people are living on the street and many of those who are housed are at risk of losing their homes because they can’t afford to pay their rent. Before the start of the legislative session, Governor Kotek made clear that addressing the unmet need was one of her top priorities. The Governor signed HB 2001 into law on March 29, a hopeful start to the session. Early in the session, the Governor assembled a package of bills under HB 2001 that addresses some of the state’s critical housing needs. The bill supports Oregon Housing Needs Analysis and associated housing production targets and reporting requirements. Funding of $25 million will help combat homelessness and those at risk of becoming homeless. The bill modifies the emergency housing assistance and state homeless assistance programs to provide services and assistance to school-aged children experiencing, or at risk of homelessness. $20 million will provide loans and grants for modular housing development with priority given to housing people displaced by natural disasters, and for the construction of low- and middle-income housing. $613,925 will fund moderate-income housing predevelopment loans; and $5 million is targeted for agricultural workforce housing. Renter notification requirements are extended when rental agreements will be terminated for non-payment, and eviction records can be sealed in certain circumstances. Emergency procurement authority was granted to Oregon Housing and Community Services to address homelessness and provide services within the OR-505 Balance of State Continuum of Care. $3 million will help nonprofits access low-cost financing by issuing bonds for affordable housing including financing to local governments or housing developers for predevelopment costs, including infrastructure, site acquisition, planning, reports, surveys, and consultants. $5 million in grants will be used to improve agriculture workforce housing. Homelessness Response and Prevention The growing humanitarian crisis of homelessness caught the attention of people around the state and prompted passage of legislation aimed at assisting people living on the street or preventing people who are experiencing housing instability from losing their homes. The 2023 – 25 FY state homeless budget includes the following: $96 million for housing and long-term rent assistance for unhoused Oregonians, $81 million for emergency rent assistance to prevent evictions and homelessness, including a 30 percent set-aside to be deployed by culturally specific organizations, and $72.2 million for shelter operations, homeless services navigation centers, and Project Turnkey transitional housing. HB 5019 is an appropriation bill of $128.2 million to provide funding to address the homeless emergency in the OR 505 Oregon Balance of State Continuum of Care. The funds will support services to homeless youth. The League provided testimony in support. Another key legislation is SB 611 that modifies the maximum annual rent increase percentage for the following calendar year as the lesser of 10%, or 7% plus the September annual 12-month average change in the Consumer Price Index. It also limits rent increases to no more than once a year. Affordable Housing Preservation and Development Oregon does not have enough housing affordable for its residents and, until the shortfall is eliminated, there will be Oregonians paying more for rent than they can afford or who are unable to find stable and suitable housing. The Legislature allocated the following resources for development of new, and preservation of existing low-income housing: · $604 million in bonding for new affordable housing development · $50 million in bonding to preserve existing regulated affordable rental housing, and mobile home parks HB 3042 provides protections for households renting publicly subsidized units in buildings with expiring affordability restrictions. Rent increases and terminations will be limited for a three-year period to give tenants time to find alternative housing. Also, legislation was signed into law that would facilitate development of additional affordable units. HB 2761 expands OHCS' ability to finance a portion of certain housing developments that are affordable to households earning at or below 120 percent of area median income. Additional Legislation HB 3215 authorizes OHCS to support replacement, reconstruction, or rehabilitation of residential units damaged or destroyed by disaster. It establishes a Disaster Housing Recovery Fund. In addition, passage of HB 3462 will make individuals affected by disasters eligible for housing assistance regardless of their immigration status. SB 599 allows tenants to operate home-based childcare by requiring a landlord to allow a renter to use a dwelling unit for a family childcare if it is certified or registered with the Office of Child Care. The landlord can require a tenant to pay for improvements necessary for certification and carry some form of liability coverage. HB 3151 limits improvements that landlords of manufactured dwelling parks may require of tenants. It expands affordable housing that is developable on nonresidential lands. It also expands the manufactured dwelling park preservation loan program to allow loaned funds to be used to develop new parks. HB 2680 requires residential landlords to refund applicants for screening charges within 30 days, subject to certain conditions. The measure requires landlords to promptly notify an applicant once the screening has taken place, their right to a refund of the screening charge, and recovery of damages if the landlord fails to provide the refund within 30 days. Homeownership SB 702 allows the Appraiser Certification and Licensure Board to require real estate appraiser training on implicit bias and state and federal fair housing laws. The League submitted a t estimony letter in support. Representative Ricki Ruiz sent a note thanking the League for its support. Unfortunately, HB 3487, which could have addressed racial disparities in homeownership did not pass. It would have required a biannual report to the Legislature on changes to racial disparity, require OHCS to partner with culturally responsive or culturally specific organizations to convene peer training programs for housing counselors, and require OHCS to develop culturally specific and multilingual financial literacy materials for distribution by mortgage brokers and bankers. Fair Housing HB 3309 directs OHCS to study and incentivize accessible units in OHCS-funded affordable housing units by providing financial support and increasing the quantity and quality of accessible units. In another loss, funding for fair housing investigation, enforcement, and education did not pass. Fortunately, however, SB 702 did pass as described above. Mortgage Interest Deduction Reform Unfortunately, the Mortgage Interest Deduction Reform bill did not advance. According to a 2022 Oregon Secretary of State a udit , this tax expenditure primarily benefits higher income households living in urban counties. The League and a number of organizations have been working for several sessions to reform the tax credit so that savings can be used to assist moderate- and low-income homebuyers and address homelessness. SB 976 , the Mortgage Interest Deduction Reform bill, has received a lot of interest because, if passed, the state’s largest housing subsidy would see some of the savings redirected away from higher earning homeowners to instead benefit low- and moderate-income home purchasers. In addition, resources resulting from reducing the subsidy would be used for homelessness prevention. The League submitted testimony in support of the reform. Oregon Housing and Community Services Budget SB 5511 is the Oregon Housing and Community Services budget bill. The total funds budget is $2,558,608,558 and 441 positions. This is a 28.5% increase from the 2023-25 current service level. OHCS’ budget from the General Fund includes the following: · $111.2 million to continue shelter and rehousing services that were funded in HB 5019 in response to the Governor’s emergency declaration on homelessness. · $24.1 million to provide operating support to existing shelters. · $55 million for rental assistance. · $6 million for services to tenants. · $10 million in down payment assistance. · $2.5 million for the decommissioning and replacement of manufactured housing. · $9.7 million to capitalize a predevelopment loan program within OHCS, and expenditure limitation and position authority were added to revamp the process the Department will use to approve affordable housing finance applications from developers, which are intended to shorten the time between project approval and construction, while helping smaller developers and projects. · $136.8 million is included in this budget in federal funds related to wildfire recovery efforts and supported by a $422 million federal grant. Criminal Justice By Marge Easley Despite the Senate shutdown, some significant pieces of criminal justice legislation were able to make it through the session. The League focused this advocacy primarily on bills related to domestic violence, sexual assault, and juvenile justice. We submitted testimony on 13 bills and reported on the progress of many, many others. Bills related to gun safety and the rights of incarcerated people are discussed under separate headings in this report. In the area of domestic violence and sexual assault, we were pleased to support the passage of bills to extend the length of restraining orders from one year to two years ( SB 816 ); create the crime of sexual abuse by fraudulent representation, spurred by the case of the West Linn doctor who abused scores of young women in his examining room ( SB 974 ); increase the statute of limitations from 12 years to 20 years for sex abuse offenses in the first degree ( HB 3632 ); expand the crime of subjecting another person to involuntary servitude ( SB 1052 ); expand the list of harassment offenses that require sex offender treatment ( SB 339 ); and allocate $10 million from the General Fund to assist victims of domestic violence or sexual assault ( SB 5506 ). The League also supported the following legislation to improve Oregon’s juvenile justice system: expand the automatic expungement of records for youth under the jurisdiction of juvenile court ( SB 519 ), require confidentiality between Oregon Youth Authority (OYA) employees and peer support team members ( SB 212 ); require county juvenile departments to conduct sex trafficking screening ( SB 745 ); allow those over 20 years of age to remain under the jurisdiction of OYA during the appellate process ( SB 902 ); regularly review demographic data to ensure OYA programs are culturally appropriate ( SB 903 ); and establish a Juvenile Justice Policy Commission to provide data-driven policy recommendations ( HB 2320 ). Gun Safety By Marge Easley Only one firearm bill made it through the gauntlet this session, due to last minute compromises to lure Senate Republicans back to the floor. HB 2500 originally contained three separate regulations, but after both an age restriction of 21 and an expansion of gun free zones were dropped from the bill, a ban on unserialized firearms (ghost guns) was the only part of the bill to successfully pass. Oregon is now one of 11 states to regulate ghost guns. Another disappointment was the failure of SB 348 to pass this session. The bill would have provided details for the implementation of Measure 114 (2022), which requires a permit to purchase a firearm and places a ban on high-capacity magazines. Meanwhile, given changes in federal firearm law as a result of the 2022 U.S. Supreme Court’s Bruen decision, Measure 114 is in the midst of constitutional challenges by firearm advocates. It passed one hurdle on July 14 when U.S. District Court Judge Karin Immergut ruled that the provisions of Measure 114 are in keeping with “the nation’s history and tradition of regulating uniquely dangerous features of weapons and firearms to protect public safety.” A state court trial will be held in Harney County in mid-September. Appeals are expected, and gun safety advocates across the country are closely watching the progress of this precedent-setting case. Rights of Incarcerated People By Marge Easley The League’s interest in the rights of incarcerated people continued this session as we provided support for the passage of several bills to improve the lives and recidivism rates of those housed in Oregon’s correctional facilities. These bills facilitate the provision of a wide array of drug treatment programs in correctional facilities ( SB 529 ); require publicly accessible data on the use of segregated housing ( HB 2345 ); and authorize the Department of Correction to enter into agreements to offer higher education academic programs to adults in custody ( SB 270 ). The League was disappointed that SB 579 , allowing incarcerated people in Oregon to vote, did not advance this session. We will continue to advocate for passage in future sessions. Immigration and Basic Rights By Claudia Keith HB 2905 : Approved: Expands the list of individuals whose histories, contributions and perspectives are required to be included in social studies academic content standards and in related textbooks and instructional materials. House Speaker and Senate President signed this bill June 24. Passed unanimously. The governor signed 7/18. SMS: Adds requirement that academic content standards for history, geography, economics, and civics include instruction on individuals who are of Jewish descent. Requires adopted textbooks and instructional materials to adequately address the contributions of men and women of Jewish descent. SB 610 A : Did not move from JW&Ms. It would have Established Food for All Oregonians (regardless of documentation status) Program within Supplemental Nutrition Assistance Program (SNAP), Fiscal, Staff Measure Summary. The fiscal may show up in the end-of-session budget balancing bill. Jump to a topic: Revenue Updates Revenue Updates By Peggy Lynch On Nov. 19, legislators received the latest Revenue Forecast . (An in-depth version is here .) Oregonlive covered the forecast helpfully. They provide an in-depth Revenue Outlook . The Oregon Capital Insider also provided a good article . However, we still have two economies: One for the wealthy and one for low-income Oregonians—the “k” economy. A Nov. 24 th Salem Reporter story provides more insights. Here is the Office of Economic Analysis (OEA) website . With concern about not only this biennium, but the next two biennia forecasted as less than needed to provide Oregonians with the services they need, the Oregon Revenue Coalition has revived. The League has participated in the past and is attending weekly meetings. For now, it is an informal group with a focus on addressing the revenue needed for services to Oregonians. We have signed on to a one-pager created by the “Protect Oregon Now” group—part of the Revenue Coalition. H.R. 1 , the federal “reconciliation” bill, was signed by the President on July 4 th , just a few days AFTER Oregon’s legislative session adjourned. Because Oregon currently “connects” to the federal tax system, the tax reductions in H.R. 1 will also reduce revenue for Oregon . A disconnect bill ( HB 2092 ) passed the Oregon House in 2025, but was not taken up in the Senate. The new Revenue Coalition and legislators are having conversations around options to increase revenue, including targeting disconnect provisions and other ideas that may be politically easier than a full disconnect. One of our partners, the Oregon Center for Public Policy, provides a YouTube video to help explain. The Legislature COULD delay the April 15 filing date should they decide to address the disconnect in the 2026 session. They have taken that action in the past. At a mtg. on Oct. 9 with the Oregon Dept. of Agriculture, League learned that agencies are being asked to provide a 5% cuts list by each fund type....so 5% General Fund (GF), 5% Lottery Funds (LF), 5% Other Funds (OF)!!! And in 2.5% increments. The 1% the Gov asked for earlier can be counted as part of that 5% number. And they are to provide a list of NEW PROGRAMS created/funded from 2025. During an OWEB mtg. on Oct. 17, we learned the New Programs list each agency is to provide are ones created from July 2021 forward. So not just the last couple of years. The Legislative Fiscal Office (LFO) is looking to see any nexus to Covid/federal programs that were created with one-time money, for instance. Some of these programs were already not funded in 2025. Oregon’s Full Ways and Means Co-Chairs have written an opinion piece about the challenges facing Oregon. The League will need to be actively engaged in helping solve these problems. See other sections of the Legislative Report about the cuts in each area and what’s being considered to address the revenue shortfall. A March 5, 2025 report by the Common Sense Institute, including former state economist Mark McMullen, provides interesting statistics on Oregon budget since 2001. As Oregon has reduced its reliance on the General Fund (income taxes), both Federal and Other Funds have grown. Yes, in spite of the revenue shortfall, Oregon still has the “kicker”. Potential 2026 Policy LC’s/Bills A bipartisan group of lawmakers is actively working on creating a new carbon market cap and trade proposal . ‘ Can Oregon and Washington Price Carbon Pollution? ‘- The Climate Trust Published: September 30, 2025 by Gloria Gonzalez, Ecosystem Marketplace's Carbon Program Environmental and social justice groups, such as the Sierra Club and Oregon Rural Action, plan to continue advocating for environmental justice during the 2026 session, focusing on issues like clean truck rules, utility rate fairness, and addressing nitrate contamination in communities of color. Make Polluters Pay: Climate Resilience Superfund : The concept is the same as SB 1187 (2025) which was introduced by Sens Golden, Pham and 9 other legislators. The policy is based on similar legislation passed in New York and Vermont. Major greenhouse gas emitters who extract or refine fossil fuels would need to pay for the impacts to Oregon of their past emissions (from 1995 to 2024). Virtual Power Plant / Distributed Energy (“VPP”): Planned bill will promote “virtual power plants” (VPPs) or distributed power plant programs, built from distributed energy resources (DERs) such as home and business batteries, smart thermostats, EV chargers, and other controllable devices. Much of the information in this webinar was adapted from Columbia Riverkeepers’ September 2025 background brief on data centers (DCs). Kelly Campbell, policy director: DCs require intensive cooling systems, consuming millions of gallons of water per day. Over a year, a 100-Mw DC will consume 100 million gallons of water, enough for 2,500 people’s domestic use. Unfortunately, DC systems that are more energy-efficient require more water for cooling. To improve our understanding of DCs’ water use and how it relates to energy consumption, we need accurate and timely reporting. If using power generated from natural gas, that 100-Mw DC will generate CO2 emissions equal to that of 60,000 cars. DC expansion is dramatically increasing electricity consumption, jeopardizing the clean energy transition. Utilities are turning to unspecified fossil power instead of renewable energy. Tech companies are pushing small modular nuclear reactors as a “clean” energy source, but it will take at least 15 years for these to become operational. In the meantime, the DCs will continue to use natural gas-fueled power. Policy strategies need to focus on transparency, accountability, and oversight. Very little information is available to the public on data center size, energy and water use, etc. DC development in Oregon has proceeded with virtually zero public input, with closed-door negotiations between elected officials and tech companies. Google and Amazon have consistently resisted transparency demands from citizens and lawmakers. The Washington governor’s work group is developing legislation to address this. Kate Valdez, tribal nations representative reported that increased peak loads are detrimental to salmon runs, which are already dangerously low. Fish operations are disrupted in “emergency” situations such as blackouts, when water flow over dams is cut off. Unsustainable growth of power demand threatens grid reliability that affects all Oregonians. DCs should pay the costs of the new infrastructure they are demanding. We need to ensure that DCs have sufficient energy and transmission availability before they begin operating, and we need closer scrutiny of tax revenue gains and losses before extending current tax incentives. Sarah Wochele, CUB, noted that Oregonians are unfairly subsidizing DCs through their monthly energy bills. Electricity is becoming “luxury priced,” threatening food security, housing affordability, etc. DC load growth is making it more difficult for Oregon to meet its clean energy targets on time and achieve a just energy transition. DCs are an unprecedented type of new utility customer. A single DC requires enough energy to power a city of 56,000 homes. The distribution system is changing, but ratepaying models are not. DCs are responsible for 94% of PGE’s recent load growth. Without their demand, PGE’s overall electric load would be declining. Investments in energy efficiency have largely been funded by residential households, while the benefits have flowed mostly to DCs. The 2025 POWER Act (HB 3546) took a step toward greater accountability by requiring the Public Utility Commission (PUC) to create a DC-specific rate class. PUC’s implementation effort has begun with its UM 2377 proceeding for Portland General Electric (PGE). Columbia Riverkeeper has intervened with a coalition of climate and energy advocates, represented by the Green Energy Institute. CUB finds PGE’s proposal seriously lacking, as it calls for residential customers to pay 42% of the investment costs of serving DCs. A complicating factor is that consumer-owned utilities not regulated by PUC serve 37% of Oregon’s electricity demand. Parties in UM 2377 will present testimony to PUC through early December. The docket is open for public comment on the importance of protecting our climate and water from DC proliferation. Columbia Riverkeeper is asking PUC to require water use reporting from DCs so we can begin to develop solutions to improve DC efficiency without harming the surrounding environment. Peter Kenagy, Albany area farmer, announced the reactivation of the Ag for Oregon group who will be advocating for agricultural land use protections and address the expansion of agri-tourism. Samantha Bayer, Oregon Property Owners Association, and member of the panel on Agri-tourism and Land Use announced that next session they will push for changes in the farm stand state statute to increase agri-tourism uses. The League may need to consider any proposed legislation. We are strong advocates of Goal 3, Agriculture.The Board approved an edited Resolution 314: Permitted Uses on Lands Zoned Exclusive Farm Use and on High-Value Farmland. A phrase was deleted from the published, edited version. There may be a special board meeting called in January for the Board of Ag to agree on legislative priorities. Here are the new Dept. of Land Conservation and Development Farm & Forest Rules. Congress passed a Continuing Resolution to fund the federal government until March 14 with $10 billion disaster aid for farmers. The bill also includes a one-year extension of the Farm Bill (until Sept. 2025). The Farm Bill includes money for nutrition programs like food stamps. It also includes $29 billion for conservation. Many of Oregon’s conservation programs rely on that federal funding. You can read more in the Oregon Capitol Chronicle . See in this legislative report under “Water” for the latest on nitrates in groundwater in the Umatilla Basin. Budgets/Revenue By Peggy Lynch The next Revenue Forecast will be Feb. 26th. The legislature will use that forecast to do a final rebalance of the 2023-25 budget. Then the May 14th forecast will be the basis for the legislature to determine the 2025-27 state budget. Now that the Governor’s budget (GRB) has been released, the state agencies, who work for the Governor, can only advocate for the GRB. Their agency request budgets (ARBs) were used as a basis for the Governor’s decisions, but it is the GRB that now governs. Look for bill numbers HB 50xx and SB 55xx for the agencies’ budgets you might want to follow. If you add them to your OLIS subscription, you will get a notice when they might be heard in one of the Ways and Means Subcommittees. After some orientation, look for budgets to be heard beginning the second week of session. The Governor proposes; the legislature disposes. And those of us who engage in the budget process now must focus on convincing legislators (especially the Ways and Means Committee and the Subcommittees) of the need to fund those programs and staffing, using the League’s Legislative Priorities | LWV of Oregon and our adopted positions as our guide. The State Debt Policy Advisory Commission will provide bonding guidance in January of 2025. Climate See the Climate Emergency section of this Legislative Report. There are overlaps with this Natural Resources Report. We encourage you to read both sections. Coastal Issues By Christine Moffitt and Peggy Lynch Among the issues the League is following are shoreline erosion , low ocean oxygen levels , and protection of eelgrass (watch for legislation). A report from the Oregon Kelp Alliance found that nearly two-thirds of the state’s kelp forests have died out over the last decade. A multitude of factors appear to be behind the decline, including rising ocean temperatures and booming populations of purple sea urchins, which eat the kelp. The report also outlines future research and conservation strategies that could help protect the state’s remaining kelp forests. “Kelp forests are a key marine ecosystem. They act as a home and nursery for a number of fish species important in Oregon’s commercial and recreational fisheries.” We have reported on the potential for offshore wind off Oregon’s southern coast. OPB explains what happened. The Offshore Wind Energy Roadmap meetings have continued. For more information, please visit the DLCD webpage here: Offshore Wind Roadmap . The West Coast Ocean Science Trust will establish a 10-year detailed suite of strategies , needed funding, and timeline to address existing, emerging, and complex West Coast ocean and coastal issues, convening and engaging key policymakers, agencies, Tribes, academic leaders, scientists, and potential funders. Department of Environmental Quality (DEQ) By Peggy Lynch Here is the Onsite Wastewater Management Program 2025 Rulemaking webpage . Because of the League’s work on SB 391 (2021) and additional bills in 2023, a League member is serving on the rules advisory committee to address sewer availability and accessory dwelling unit (ADU) issues. Department of State Lands (DSL) By Peggy Lynch See Elliott State Research Forest below for the agency’s role in that issue. The next State Land Board meeting is Feb. 11. Drinking Water Advisory Committee (DWAC) By Sandra Bishop At the Drinking Water Advisory Committee (DWAC) meeting January 15th, it was announced that Oregon Health Authority (OHA) will adopt a new definition of Disadvantaged Community (DAC). The DAC definition is used to prioritize eligibility for public funds to improve public water systems. Oregon, like all states, has a priority ranking system to address first any problems with public water systems that have the most serious human health risks. The state is also required to have a definition of disadvantaged community that meets the state affordability criteria for customers served by a public water system. This is to help prioritize eligibility for use of Drinking Water State Revolving Funds (DWSRF). The new Disadvantaged Community definition addresses other socioeconomic, environmental justice, and demographic considerations, beyond the one-income criteria in the current definition. The current DAC definition used to determine DAC status for funding water projects is: A public water system with a service area that has a Median Household Income (MHI) less than the state MHI. The new definition defines Disadvantaged Communities (DAC) as any public water system (PWS) with a Median Household Income (MHI) less than the state MHI, or If a PWS has an MHI higher than 100% of the state MHI but less than 120% of the state MHI, then the system must meet two (2) of four (4) criteria: Greater than the state poverty rate, Greater than the state unemployment rate, Greater than the state percentage of people with less than a high school education, Greater than the state housing cost burdened. The new definition was arrived at after public comment and cooperative work between OHA Drinking Water Services staff, Business Oregon, and an EPA State Revolving Fund contractor. Metrics for determining need were expanded and refined. The new broader definition of Disadvantaged Communities includes an additional 79 public water systems serving a total population of more than 2,500,000. The new definition will also include the nine federally recognized tribes in Oregon. Approximately 61% of the public water systems in the state and 69% of the population served by public water systems will be covered under the new DAC definition . There was also news about Small System Equipment Assistance (SSEA) forgivable loans. A pilot of this program was implemented in 2021 but was suspended as federal BIL (Bipartisan Infrastructure Law) funding superseded the available staff capacity to manage the program. The Drinking Water State Revolving Fund (DWSRF) plans to re- launch this program. Application submission deadline will be August 15th, 2025 for small-scale additions or replacement of equipment and instrumentation needed by small water systems (serving less than 300 connections). Funding for projects will be up to $20K in 100% forgivable loans. Program materials and additional information are being prepared and will be available soon on OHA’s DWSRF webpage . Elliott State Research Forest (ESRF) By Peggy Lynch The final environmental impact statement for the proposed Elliott State Research Forest Habitat Conservation Plan (HCP) is now available, the U.S. Fish and Wildlife Service announced today. Read the Service's press release here . The HCP balances forest research and management activities with the conservation of rare species and their habitat in the Elliott State Research Forest. The final Environmental Impact Statement (EIS) is one of the last steps before federal agencies decide whether to issue incidental take permits to the Department of State Lands for federally protected species based on the HCP. The Dept. of State Lands is asking for $10 million General Funds in 2025 as, hopefully, final bridge financing to continue to stand up the ESRF, hire staff and work toward self-funding in the future. Forestry (ODF) By Josie Koehne See the Wildfire section of this report below and the Forestry report in the Climate section of this Legislative Report. Land Use & Housing By Peggy Lynch The League has again participated in a Land Use 101 webinar focusing on the statewide land use planning program with emphasis on Goals 3,4, 7, 10 and 14. One of the many 2025 session bills the League will be following and engaged in during its development is HB 2138 . As explained in this OregonLive article , the Governor looks to continue to increase middle housing opportunities. Because the bill had to be filed in Sept., expect a significant amendment to be posted before the first public hearing in the House Housing and Homelessness Committee. SB 1537 (2024) provisions went into effect Jan. 1st, including “adjustments” that can be made by cities rather than going through a variance process. Then the Oregon Housing Needs Analysis program will begin to be implemented “to facilitate housing production, affordability and choice to meet housing needs for Oregonians statewide. Three state agencies have vital roles in implementing the Oregon Housing Needs Analysis (OHNA). Oregon Department of Land Conservation and Development (DLCD), Department of Administrative Services (DAS) and Oregon Housing and Community Services (OHCS) are undertaking various tasks outlined by House Bill 2001 (2023) .” In order to see significant new housing, the League has continued to advocate for funding for infrastructure. The League of Oregon Cities provided 2024 Survey results : ”If all infrastructure needs across all types are summed, we find a tremendous amount of funding is needed. In total, as can be seen in Table 21, the total infrastructure needs for cities across both water and transportation projects is $12.2 billion.” Starting at page 35, you can read the list of needed projects and the possibility of housing IF the funding is found. Here are the new Dept. of Land Conservation and Development Farm & Forest Rules (also posted under the Agriculture section of this report). Mining The League has continued to follow the application for the Grassy Mountain Gold Mine near Vale. The next meeting of the interdisciplinary team of agencies will be January 30th on the proposed chemical process gold mine in Malheur County. The public notice and related documents are available. This is the first project using a consolidated permitting process where all permitting agencies are meeting together to process the permit applications. Oregon Watershed Enhancement Board (OWEB) By Lucie La Bonte We have a new League volunteer who will be following OWEB’s meetings and reporting on this important state agency. From its beginning as part of the Plan for Salmon and Watersheds with a portion of lottery funding, their success in funding grants has raised their stature. The legislature has added a number of other programs, including distribution of the Natural and Working Lands Funds and the Drinking Water Source Protection Fund (General Funds), both of which the League has supported. Water By Peggy Lynch The League will provide our first natural resources area testimony on HB 2168 on Wed. Jan. 22nd at the House Agriculture, Land Use, Natural Resources, and Water Committee. The bill requests $5 million for the on-site septic loan program, another $5 million for the Well Water Repair and Replacement Fund, and monies to help the Oregon State Extension Service reach out to potential recipients. The League has been a perennial supporter of the two loan programs from their inception. Another bill, SB 830 , that the League will also support when posted, would allow for grants in the on-site septic program and extend the opportunities to low-income mobile home parks with failing septics. The Governor declared an emergency for the Port of Morrow “My office has heard directly from producers and farmers in the Lower Umatilla Basin that pausing operations even for a short time in February would be devastating to the local economy and potentially shut down some operations permanently,” Kotek said in the release. “I did not make this decision lightly. We must balance protecting thousands of jobs in the region, the national food supply, and domestic well users during this short period of time during an unusually wet winter.” The League is distressed that the low-income groundwater well users are again not addressed . The League is proud to have been a part of advocating for many of these 2021-2024 Oregon Water Resources Dept. investments . But there is more to do. The League has been invited to participate in discussions on a new Water Stewardship and Supply Initiative with its updated scope . LC 3542 has been filed, and this work will flesh out the proposed bill which “Directs the Water Resources Department to study the use of water resources in this state. Directs the department to report to committees or interim committees of the Legislative Assembly related to natural resources no later than September 15, 2026.” League members may want to check the U. S. Drought Monitor , a map that is updated every Thursday. Here is a more complete website about drought in Oregon. Wildfire By Carolyn Mayers The devastating fires in the Los Angeles vicinity have dominated headlines recently, highlighting the oft-referenced sentiment among the wildfire community in Oregon and nationwide that we no longer have a wildfire season, but “wildfire years”. Many California wildfire personnel and agencies had assisted during Oregon’s record wildfire season last year, and our Oregon State Fire Marshal (OSFM) and Oregon Department of Forestry (ODF) have provided significant and timely resources in the form of equipment and firefighters to help suppress these recent fires and save lives. The League followed with great interest the first meeting of the year of the Governor’s Wildfire Programs Advisory Council (WPAC) on January 17. After the introduction of new members, the Council received an update on Oregon’s support of California agencies in the wake of the wildfires. Details of resources provided to California were given by Chief Ruiz Temple of OSFM. Her report is well summarized here . She noted that resources were deployed within 12 hours of the first conversation between the two States, and that Oregon firefighters were the first out-of-State team to arrive on the scene. She also stated it was the largest out of State deployment in the history of the agency. Chief Ruiz-Temple’s report was followed by details of the response sent to California by ODF, which was coordinated with CalFire, California’s Department of Forestry and Fire Protection. Deputy Kyle Williams spoke of how well the two agencies, OSFM and ODF, work together and that they are really more than the sum of their parts. You may read about the details of those ODF deployments here . It was noted that while containment of these fires is increasing, there are troubling signs of returning dangerous Santa Ana winds mid-week. Finally, the Chief stated that while normally a deployment lasts only 2 weeks, the need may well arise to extend that. The Council relayed the fact that availability of the off-season ODF personnel was the direct result of the Legislature following through on a recommendation from the WPAC to allow some of the seasonal personnel to stay on beyond the normal fire season. They were pulled from fuels reduction/mitigation work that they normally do this time of year. The Los Angeles fires have, once again revealed vulnerabilities in our current approach to wildfire, especially in urban areas. There have been a number of recent articles covering these vulnerabilities. Urban water supply and its reliability in the face of a large urban conflagration is one area that isn’t discussed enough, and this article details that issue. This one paints a clear picture of the importance of fuels reductions and defensible space around the home, and home hardening techniques, which was also a topic of discussion at this same meeting. New regulations for homeowners in the Wildland Urban Interface areas which also fall in areas rated High Hazard on the new map , will be forthcoming, following the appeals process and once details are worked out. Building Codes and Defensible Space Code will be available before the end of the year, though the timeline for finalization and enforcement varies from agency to agency. There has apparently been a sizable outcry, as with the release of the first map, so the appeals process will take time. Regulations around defensible space and home hardening hinge on the aforementioned State Wildfire Hazard map. A very thorough OBP article details the map, its history and next steps. Derrick Wheeler, Legislative Coordinator for ODF, and Andy McAvoy, Oregon State University Wildfire Risk Research Scientist, gave an overview of the mapping process and purpose, and the appeals process. Doug Graf, the Governor’s Wildfire and Military Advisor, told WPAC members that there are approximately 50 wildfire-related bills coming in the 2025 session, and that more details would be forthcoming. One bill was highlighted in Senator Jeff Golden’s most recent Newsletter , and would establish a Climate Superfund Cost Recovery Program within the Department of Environmental Quality. SB 682 looks to take advantage of a trend in getting “polluters to pay” for the effects of climate change, such as increased wildfire risk, flooding and more. Clearly, it is another angle on trying to find creative ways to fund the wildfire crisis, among other crises, being exacerbated by the effects of climate change. In other news, Cal Mukumoto turned in his resignation from ODF effective January 23, following a number of charges of not keeping the Legislature informed of the agency’s inability to pay vendors in a timely fashion for their help during the record 2024 wildfire season. That state of affairs led to the passage of an emergency wildfire funding bill, passed in Special Session, December 11, 2024. Finally, the Wildfire Funding Work Group, which was established by the Governor during the short session to find sustainable, adequate and fair funding for the wildfire crisis, will be presenting a report to the Legislature on February 18, 2025. A not-so-fun factoid from the New York Times: Between 1990 and 2020, the number of homes in fire-prone parts of California grew by 40 percent, according to research led by Volker Radeloff, a professor of forest ecology at the University of Wisconsin-Madison. By contrast, the number of homes in less-flammable areas, like city centers, only grew by 23 percent. VOLUNTEERS NEEDED: What is your passion related to Natural Resources? You can help. HB 2816 High Energy User Facilities Requires person who owns, operates or controls high energy use facility to ensure that greenhouse gas emissions associated with electricity used by high energy use facility are reduced to 60% below baseline emissions levels by 2027, 80% below baseline emissions levels by 2030, 90% below baseline emissions levels by 2035 and 100% below baseline emissions levels by 2040. Imposes civil penalty of $12,000 per megawatt-hour in violation for each day of violation. Excludes property that is or is part of high energy use facility from enterprise zone tax benefits unless amount of greenhouse gas emissions associated with electricity that high energy use facility uses complies with amount of greenhouse gas emissions associated with electricity permitted for high energy use facilities. LWVOR was in the process of writing testimony for the public hearing scheduled for February 1 but received notice that the bill had been removed from the schedule. We had a lot of concerns with the bill, so will wait to see if an amendment is submitted. No Clean Energy bills are currently scheduled for public hearings next week, may be later. Oregon Economic Analysis By Claudia Keith The next Oregon Economic and Revenue Forecast is scheduled for Feb 22. It is unclear how the very volatile security market, banking issues / risk will develop. The last State of Oregon quarterly forecast assumed a likely mild recession in 2023. The Oregon Office of Economic Analysis has never conformed to what is now recommended in the SEC Climate Risk disclosure rule. Climate Related Lawsuits: Oregon and… By Claudia Keith Numerous lawsuits are challenging Oregon’s DEQ CPP regulations. Here is one example of how to track them. Basically, there are a number of active state and federal lawsuits , (Feb 2023 update) some of which could assist in meeting Oregon's Net Zero GHG Emissions before 2050 targets and other lawsuits which challenge current Oregon DEQ CPP policy which would limit the use of fossil fuels, including diesel, natural gas, and propane over time. Jump to topic: After School and Summer Behavioral Health Education Gun Policy Housing Legislation Immigration Public Safety After School and Summer By Katie Riley The two bills we have been following that most closely align with funding for afterschool and summer programs look like they may be combined and will be focused instead on summer school (emphasis added), literacy, and accountability for that instruction. HB 3039 would appropriate moneys from the General Fund to the Department of Education and Requires the Department of Education to study methods for increasing the availability of summer and after-school academic and enrichment programs. HB 2007 would modify requirements for the summer learning program. Both bills have received amendments and HB 2007 has received a hearing and a second amendment that deleted the possibility of funding for for-profit providers. Although HB 2007 refers to “expanded learning” and community-based organizations (CBO’s), any funding would be directed to school districts and through them to CBO’s and there is no specific allocation to CBO’s for summer care. CBO’s are upset about the major focus on summer school and literacy. They support literacy but believe that learning takes place during non-school time as well and includes social emotional learning. In addition, attendance in afterschool programs has been proven to decrease absenteeism and increase academic achievement. Further, the task force established by the 2024 legislative session for HB 4082 recommended funding for after school programs and there is no provision for that specific funding in either bill. HB 2007 is now scheduled for an informational hearing in the Senate Committee on Education on March 31st and a work session on April 1st in the Joint Subcommittee on Education. HB 5047 is proposing $35 million for summer learning in 2025 plus $47 million for 2026 and 27. It will be discussed in the work session. A new bill ( HB 3941 ) was introduced last week to allocate $4,990,000 for a grant program to establish up to 5 community schools at $170,000 per year in matching funds. Community schools coordinate and integrate educational, developmental, family, health and other comprehensive services through community-based organizations and public and private partnerships to students, families, and community members during and after school hours, on weekends, and during the summer. A public hearing on the bill is scheduled for March 31st in the House Committee on Education and a work session is scheduled for April 2nd in the same committee. In an interesting twist, SB 1127 provides for grants to develop and provide educational activities during recess, lunch or after school for Title I elementary schools. It received a public hearing this past week. SB 896 which would provide funding for afterschool grant programs passed out of the Senate Committee on Education and has been sent to Ways and Means. Another bill ( HB 3162 ) to fund after school programs was introduced but never received a hearing so it is unlikely to be heard from again this session. On a positive note, the fact that more than one bill is concerned with after school care makes it more likely that the issue will receive attention from House and Senate leadership. Bills concerned with child care are also moving through the legislature. HB 2593 would direct the Department of Early Learning and Care to study the characteristics of the people who are on the ERDC waitlist (currently over 10,000) to determine the impact of being on the waitlist. The bill received a hearing this past week with no opposition. Other bills ( HB 3496 and HB 3560 ) concern establishing guidance to site child care facilities in local areas and expands areas where child care can be cited. Since these bills are focused on being able to provide child care in more rural areas that currently are zoned to prohibit this use, there are concerns about children being exposed to pesticides. Behavioral Health By Stephanie Aller and Patricia Garner A number of health care related bills have been heard in the Behavioral Health Committee which arose out of the Behavioral Health Transformation Workgroup convened by Senator Kate Lieber and Representative Bob Nosse. They have all been scheduled for Work Sessions and seek to address problems with services for high acuity patients, reduce administrative burdens and improve rates for behavioral health services. They are primarily appropriations bills but instead of appropriating a sum with limited requirements, they reach into the details or “nitty-gritty” of how treatment is provided. Support for the bills is nearly unanimous. They will be sent to the Joint Ways and Means Committee next. HB 2015 with -2 amendment addresses a number of regulatory barriers in building and operating secure residential treatment facilities (SRTF’s), residential treatment facilities (RTF’s) and residential treatment homes (RTH’s) in Oregon. The bill is detailed and far-reaching. On the surface it appears to be a bill setting up a study, but it directs OYA to find solutions for a number of these barriers. For example, Trillium Family Services is Oregon’s sole provider of a full continuum of mental health services for youth aged 5 – 24 and has a staff of 685 employees. According to current regulations such a facility must be licensed with and provide services and documentation as both a child caring agency and an adult residential treatment provider. This is time consuming and takes away from the provision of treatment. Another example relates to nurse staffing. These facilities are required to have one nurse on site at all times, and not just on-call, which is particularly challenging for non-urban settings. OYA also currently requires a facility to be fully licensed before it can accept patients rather than allowing admission after a certain point in the licensing process. Financial compensation for residential services is based on the acuity of an individual’s treatment, but when an individual has received an appropriate level of services, by definition the acuity decreases, and the facility is paid less. The bill seeks to group people in facilities by level of acuity. The House Committee on Behavioral Health and Health Care held a public hearing on HB 2059-2 (Behavioral Health Facilities). The League has submitted testimony in support of the bill. HB 2059- 2 would fund residential behavioral health facilities throughout the state by allocating $90 million from the General Fund for the 2025-2027 biennium. This allocation was included in Governor Kotek’s recommended budget. Several witnesses, including OHA and NAMI, detailed the critical shortage of beds in these facilities. Oregon’s sole state psychiatric hospital is occupied almost exclusively by individuals whom courts have deemed mentally incapable of being able to “aid and assist” in their defense of criminal charges, and even when they are ready to be released, there is a lack of residential treatment or step-down facilities that can take them. Because the hospital is full of these individuals, those in need of civil commitment or a hospital level of care are not able to receive it. A number of witnesses also referred to Oregon Advocacy Center v. Mink , a federal case in which the judge has ruled the state psychiatric hospital must accept within 7 days people found not able to “aid and assist” in their defense. Because Oregon is out of compliance with this order, it could be held in contempt and face significant fines. (See KGW8’s report on the recent hearing in the case - KGW8 Mink case ). HB 2059-Dash 2 also requires OYA to develop guidelines for distributing these funds, which must at least include the ability to quickly put funding to use – including the availability of service providers, the bed-to-cost ratio with priority being given to shovel-ready projects, geographic equity across the state, and local community input on projects that will serve the highest need. A work session for HB 2059 has been scheduled for April 3. HB 2024- 3 provides funding to increase Oregon’s behavioral health workforce. Twenty million dollars is allocated to the OHA to award grants to several classes of behavioral health care providers, including for example: providers that offer office-based medication-assisted treatment, certain Indian health programs, programs that offer behavioral health care and substance abuse rehabilitation services, and programs that provide outpatient behavioral health care for adults or youth of which at least 50% are uninsured or receiving Medicaid or Medicare. The grants can be used for educational scholarships, loan forgiveness, housing assistance, sign-on and retention bonuses, childcare subsidies, tuition assistance, stipends for supervisors of interns or graduate students and more. An additional $20 million is directed to OHA to develop and implement incentive payments which are designed to increase the wages of residential, out-patient, outreach and medically assisted treatment providers so they are competitive with for-profit and hospital providers. Finally, $5 million is allocated to the OHA for the purpose of establishing a “United We Heal Health Medicaid Payment Program” which is designed to enhance training, education and apprenticeship opportunities, as well as provide increased wages, health care benefits and workplace safety standards for residential treatment providers. HB 2202-1 identifies certain redundancies, contradictions and outdated language regarding services provided by coordinated care organizations. For example, in attempting to deal with parity of mental and physical health treatment, the bill prescribes that the OHA must require CCO’s to report on their document standards or requirements used for providing behavioral health, substance abuse, as well as for medical and surgical treatment and services. The standard for provision of CCO services must also “support an individual’s progress towards clinical goals, as defined by the individual’s service plan,” instead of the prior standard which was defined as “leading to a meaningful improvement in individuals’ lives.” Abuse reports are also authorized to be made electronically instead of only by telephone. Instead of using the term “emotional disturbances,” HB 2202-1 substitutes the more commonly used phrase “health or substance use disorders.” HB 2056 -1 appropriates $64,800,00 for community mental health programs. It comes in response to the 2024 legislative mandate to analyze costs these programs incur when providing crisis services, services to the “aid and assist” population and adults who meet the criteria for civil commitment. The intent of the allocation is to support early intervention instead of resorting to criminal or other last resort systems of care. This funding is also considered to be crucial in meeting Oregon’s Constitutional obligations to provide treatment which is currently under review in federal court. It is argued that if this funding is not provided, Oregon may be fined. The State of Washington was fined $100 million for a similar failure to provide treatment. Education By Jean Pierce Federal Actions affecting Higher Education in Oregon This week, the federal government reinstated 3 Income Driven Repayment plans for student loans, which had been cut a month ago: Pay As You Earn Income Contingent Repayment Plan Income-Based Repayment Plan According to the Attorney General’s office , “Most students in Oregon rely on student loans to help pay for their education. The average Oregon student loan borrower owes over $36,091 by the time they graduate. Combined, Oregonians have more than $18.9 billion dollars in student loan debt. “ Two resources are available to help students find answers to their questions about the changing policies: Since 2022, the state has a student loan ombudsperson Representative Bonamici’s office has created a webpage covering the basic questions about returning to loan repayment . Legislation we are tracking In addition to the bills for which we submitted testimony, LWVOR is tracking a couple of bills which saw action this week in the House Education Committee: The committee held a public hearing on March 24 for HB3004 , which directs the Youth Development Division to establish a statewide community violence prevention program. A work session is scheduled on March 31 for HB3037 , which creates a program designed to reduce the administrative burden on small districts applying for and reporting on grants. Gun Policy By Marge Easley A busy week turned even busier when four bills related to firearms ( SB 696 , SB 697 , SB 698 , and SB 429 ), originally slated for an April 2nd omnibus hearing in the Senate Judiciary, were suddenly folded into a fifth bill, SB 243 . SB 243 was heard on March 27 with over 80 people signed up to testify, despite only 24 hours notice. A work session is scheduled for April 3. The bill would make the following changes to Oregon’s gun laws: Mandate a 72-hour waiting period for the purchase of a firearm Require the completion of a background check before the transfer of a firearm Ban rapid-fire devices, such as bump stocks, that allow semi automatic guns to function like machine guns Raise the age to purchase military-style rifles from age 18 to 21 Expand the number of public spaces that can be designated as “gun-free zones” The League, along with other members of the Alliance for a Safe Oregon , supports these provisions. However, the expected strong pushback from the gun rights community is now underway, as reported by OPB. Stay tuned for an upcoming action alert prior to the Senate floor vote. An April 2nd work session in the House Judiciary on two additional gun bills. HB 3075 provides implementation details for Measure 114, while HB 3076 establishes a gun dealer licensing program. An ambiguous third bill, HB 3074 , has a hearing and work session on April 8, so it’s possible it will be the catchall for last-minute changes. On March 26, a US Supreme Court ruling provided some very good news for gun safety supporters around the country. By a 7-2 vote, justices upheld a Biden-era rule regulating “ghost guns,” untraceable firearms without serial numbers that are assembled from components or kits that can be obtained online. Oregon’s prohibition on ghost guns has been in effect since September 1, 2024. Housing By Nancy Donovan and Debbie Aiona Predevelopment Loan Program: On March 19, the House Committee on Housing and Homelessness held a hearing on HB 2964 , which would give Oregon Housing and Community Services responsibility to administer a grant and loan program for predevelopment costs for new affordable housing for low-income households to rent or own. The department would also provide technical assistance to nonprofits who receive the funding. Eligible predevelopment costs include professional services; studies such as site feasibility; development fees, and community engagement. OHCS would integrate this program into its existing Predevelopment Loan Fund with monies from the General Fund. Properties would be developed with affordability restrictions to ensure that they remain affordable for people with lower incomes. Oregon's population growth has outpaced housing construction leading to a severe shortage of affordable properties. This bill will give our state’s lower income households an opportunity to live in stable, new and affordable housing. The League presented testimony in support of this bill. Individual Development Accounts: On March 26, the House Committee on Housing and Homelessness held a hearing on HB 2735-2 related to funding for Oregon’s Individual Development Account program. The program provides matching funds for lower income Oregonians saving to buy a home, further their education, start a small business, or engage in other efforts intended to meet their financial goals. The funds for the match come from a tax credit that has been capped at $7.5 million per year since 2009. The bill, if passed, would raise the cap to $16.5 million, avoiding the need to reduce the number of participants. The League submitted testimony in support. Rent Stabilization and Rent Setting Software: Also on March 26, the Senate Committee on Housing and Development held a public hearing on SB 722 to prohibit residential landlords from software and occupancy control, and would apply rent caps for younger properties. This proposal would help prevent displacement by prohibiting landlords of multifamily housing to use price-fixing AI software to inflate rents or occupancy rates. This unethical practice is the subject of national attention . Attorneys General in eight states, including Oregon, have joined the Justice Department in an antitrust suit to disallow this method of sharing and aligning non-public information to drive up rents. The bill also would reduce the current 15-year exemption for new construction from our statewide rent stabilization statute down to seven years. This change would provide reasonable rent stabilization protection for an additional 40,000 housing units and between 80,000 to 100,000 Oregonians. The League sent testimony in support. Affordable Housing Insurance Program: The Senate Committee on Housing and Development held a March 26 hearing on SB 829 , proposed by Governor Kotek to establish an Affordable Housing Insurance Program in the Department of Consumer and Business Services (DCBS). The program would provide financial assistance for eligible entities having difficulty covering the cost of their insurance premiums. DCBS would also study the feasibility of creating a state reinsurance program that would bring price stability to the multifamily housing insurance market. Of all the expenses multifamily housing providers pay, insurance premiums have increased at the highest rate during the 2010 to 2022 time frame as compared to other costs. This program seeks to address the challenges providers face maintaining financial stability as they work to meet the needs of the most vulnerable households. Immigration By Becky Gladstone and Claudia Keith HB 1191 , Senate Judiciary heard the “know your rights protection bill”, work session slated for April 2. League testimony supports SB 1191 which excludes the act of informing another person of their civil or constitutional rights from statute defining “commits the crime of obstructing governmental or judicial administration”. This is relevant as League voter service activities and advocacy issues are newly vulnerable to Executive Order classification as domestic terrorism if not aligned with recently changed federal preferences. The League will continue to support legislation for DEI, climate change, immigration, access for voter registration and election process information, protecting our natural resources, and more. SB 703 passed 4-2 on partisan lines from Senate Rules, for Dept of Human Services grants to nonprofit service providers to help noncitizens change their immigration status. Since it has been reorganized, the presentations by the staff have been detailed with attorneys working under the new system giving their perspective. The new agency operates under the Executive Branch. The House Judiciary Committee listened to proposals for public defenders in County Circuit Court Districts. HB 3376 proposes an office of district defender in each county court. The Early Childhood and Human Services Committee heard testimony on HB 3835 which deals with restraint and seclusion practices within foster care placements and special education programs. Courts and Privacy By Becky Gladstone HB 5012 : The League was invited again to speak to this Oregon Judicial Department budget bill. League testimony in support was presented. HB 5012 appropriates monies from the General Fund to the department for the Oregon Law Commission, the Council on Court Procedures, conciliation and mediation services in circuit courts, law libraries and the Legal Services Program. HB 2299 , which increases the penalty for unlawful dissemination of intimate image, was heard this week in the House Judiciary committee. Government Ethics By Chris Cobey HB 2454 authorizes the Joint Legislative Audit Committee to appoint a Legislative Audit Officer and to direct the officer to perform specified duties, including investigating, reviewing activities of and oversight of executive branch agencies, taking in and investigating complaints of members of the public concerning executive branch agency programs, conducting performance audits of executive branch agencies and reporting to the committee on work undertaken by the officer. The only witnesses were Reps. Bowman and Wallan. This new legislative branch audit office (LAO) may be redundant with the Secretary of State audits division and the Legislative Fiscal Office (LFO). Revenue By Natalie Briggs On March 26, the Senate Committee on Finance and Revenue heard the March Economic and Revenue Forecast by Chief Economist Carl Riccadonna and Senior Economist Michael Kennedy. The Macro Forecast At the time of this report, U.S. inflation adjusted growth is 2%, while inflation is holding steady at 2.8% (above the federal reserve’s target of 2%). Unemployment is 4.2%, though it is too early to observe the impact of tariff discussions and federal job cuts. Federal job cuts will not be included in Oregon’s economic statistics until the 1st or 2nd week of March. In 2025, 2% growth is targeted, and economists anticipate a broader set of risks to economic outcomes. Implementation of tariffs could harm or help the Oregon economy, which is sensitive to trade due to the geographic and industrial characteristics of the state – manufacturing and export are higher in Oregon than other states, and Oregon may be impacted more heavily by changes to pacific trading partners, due to geographic location. Oregon Outlook/Economy Oregon GDP growth has slowed over the last year, with GDP growth reaching 1.2%. Decrease in GDP is likely tied to state-specific industries, and does not necessarily reflect national GDP trends. At the time of this report, Oregon GDP is below the US average by 1.5%. Should this deviation from national GDP trending continue, a U.S. GDP growth of 2% in 2025 would contrast with Oregon GDP growth of 0.5%. Despite Oregon’s 1.2% growth over the last 4 quarters, GDP growth over the previous two quarters was 2.9%, up markedly from -0.6% in the two quarters prior. This growth of 2.9% could indicate improvement in GDP to come. Jobs Oregon has a high percentage of labor force participation compared to the rest of the country, though hiring has slowed. Oregon employment remains at a historic high (since 2000), at 81.9%, with wage growth relatively flat and some recent indication of an upward slope. The number of unemployed Oregonians who have exhausted unemployment benefits is beginning to increase somewhat compared to 2024. Areas with the most job creation include private education, health care, and service industries. Job losses have been observed in areas including construction and manufacturing. Manufacturing jobs are down 2,500 between December 2023 and December 2024, as noted in the previous revenue report, though some signs of manufacturing improvement have been observed recently. Overall, no broad-based gains in employment were observed, and jobs trends do not appear to differ dramatically from national trends. Interest rates remain a challenge for certain industries in Oregon (automotive, housing), and are reflected in the Oregon labor market. These challenges are not unique to Oregon, and other states see similar patterns, such as migration to neighboring states where housing costs are lower. Outcomes The Oregon economy is increasingly connected to national trends, in part due to the existence of industries that are impacted by the national economy. As a result, one possible outcome for the Oregon economy is that of a soft landing – a term applied at the national level that refers to slowing of growth post-inflation rather than a transition to recession. The baseline outcome for the Oregon economy is that of a soft-landing. Other outcomes include that of a recession (downside), and continued growth (upside). Revenue Update The latest Oregon revenue projection for 2023-2025 has decreased by $89 million compared to prior forecasts, and appropriations have increased by $110 million. 2025-2027 revenue projections have increased to $551 million, and available resources have increased to $350 million. The decrease by $89 million for 2023-2025 is a result of updated information on income taxes, where Oregon personal tax refunds have accounted for $275 million more than in prior projections. Corporate income tax is also lower than expected, due to reconciliation from prior years. The variance in these forecasts may be up to $500 million. Looking forward to the next 10 years, slower growth is expected for Oregon, due to a combination of demographic changes, including an aging population and out migration of high earners, as well as slow capital gains growth. Biennial growth is expected to slow for 2025-2033, to 10.7% (down from 15.1% for 2021-2025). The current budget reserves for Oregon are 10.5% of 2025-2027 general funds. The legislature will use this Feb. 26th forecast to do a final rebalance of the 2023-25 budget. Then the May 14th forecast will be the basis for the legislature to determine the 2025-27 state budget. Oregon receives substantial funding from the federal government, so the legislature is watching closely as the March 14th deadline for a federal budget to be passed again looms. Congress also needs to address raising the federal debt limit to authorize paying for bills we’ve already incurred. The federal budget is annual and runs Oct. 1-Sept. 30. Currently there is only a federal budget until end of day March 14. Additionally, the firing of federal employees who live in Oregon is beginning to affect both large and small communities in Oregon—not only the jobs they were hired to do, but economies with the loss of those employee wages to the communities. Bishop The first meeting of the Farm Stand Rulemaking Advisory Committee (RAC) was held on May 16th. ( OAR 660-033-0130: Regarding farm stands in exclusive farm use (EFU) zones and agri-tourism) Staff introduced the topics and areas of endeavor that will be considered by the RAC. The online meeting was live-streamed and recorded and may be reviewed on the Oregon Department of Land Conservation and Development (DLCD) YouTube channel . The 20-member RAC is expected to meet 4 or 5 times. The public hearing will likely be in September. 2025. This is Phase 1 of the Farm Stand Rulemaking. After the conclusion of this rulemaking process, DLCD will recommend a work plan for phases of OAR changes to address agri-tourism and other commercial events, use of soils reports, replacement dwellings and non-farm dwellings. The public comment period for this rulemaking will close October 5, 2025. To submit public comment please email written comments to: farmforest.comment@dlcd.oregon.gov Comments must be in writing to be considered part of the rulemaking record. People may also make brief public comments at the RAC meetings. The next RAC meeting is Tuesday June 3rd. Rulemaking webpage AIR QUALITY SB 726 A would direct the Environmental Quality Commission to adopt rules requiring the use of advanced methane detection technology for surface emissions monitoring at municipal solid waste landfills, beginning 1/1/2027. The A7 amendment limits the bill's application to a landfill located in Benton County (e.g., Coffin Butte). May 29: The bill failed on the House floor; 29/22! However, Leader Bowman served notice of reconsideration. It will be up for another vote in the House on June 2nd. Related to this bill is HB 3794 , a bill that would create a Task Force on Municipal Solid Waste in the Willamette Valley. HB 3794 is sitting in Ways and Means. BOTTLE BILL UPDATE By Sandra U. Bishop The omnibus bottle bill SB 992 A , a conglomeration of several bills introduced this session to address problems with beverage container redemption in the Portland area, is now awaiting the Governor’s signature. BUDGETS/REVENUE By Peggy Lynch Following are the budget bills we are watching in Natural Resources. After passage by the Full Ways and Means Committee, the bills go to each chamber for a final vote and then on to the Governor. These agency budgets are moving quickly now that the Co-Chairs know the revenue they have to spend: Dept. of Agriculture: SB 5502 Dept. of Agriculture Fees: SB 5503 Both bills passed Full Ways and Means and are now headed to the Senate and then House floors for a final vote. Five bills related to department’s various fee increases also passed Full Ways and Means. HB 2805 Relating to food establishment licenses ( Meeting Materials ), HB 2806 Relating to license fees for commercial instruments ( Meeting Materials ), HB 2809 Relating to pesticide registration fees ( Meeting Materials ), SB 1019 A Relating to brands ( Meeting Materials ), SB 832 A Relating to civil penalties for laws implemented by the State Department of Agriculture ( Meeting Materials ) Columbia River Gorge Commission: SB 5508 LFO Recommendation The bill passed Ways and Means and the Senate. Now to the House chamber for a final vote and on to the Governor for her signature. Dept. of Environmental Quality: SB 5520 League testimony . The budget bill had a work session on May 21. LFO Recommendation and Meeting Materials The bill passed Full Ways and Means after a contentious discussion and now heads to the Senate and then House floors for a final vote. Oregon Dept. of Energy: SB 5518 and Oregon Dept. of Energy Fees: SB 5519 Meeting Materials . Bills passed Full Ways and Means and are now headed to the chamber floors for a vote. Among the good news is that the Oregon Climate Action Commission is being provided with one full time permanent staffer. Oregon Dept. of Fish and Wildlife: HB 5009 . Conservationists, with HB 2977 (a -2 amendment has been filed), would add 1% (or 1.5%) for conservation programs. That additional money would go to a special Fund at the Oregon Dept. of Fish and Wildlife. It had a hearing in House Revenue on May 8. Work Session on HB 5009 on May 28 ( LFO Recommendation ), along with HB 2342 A ( LFO Recommendation ) Relating to fees concerning wildlife, HB 2343 A ( LFO Recommendation ) Relating to the Columbia Basin endorsement and HB 2345 ( LFO Recommendation ) Relating to Oregon hatcheries. “The recommended investments support monitoring and fish screening efforts in the Klamath Basin, fish and wildlife passage projects, monitoring and prevention of harmful algal blooms and aquatic invasive species, chronic wasting disease surveillance, climate solutions policy and projects, administration operation efficiencies, and the Private Forest Accord grant program.” Additionally, POP 125 of HB 5009 “establishes one permanent full-time Natural Resource Specialist 4 position (0.88 FTE) as a climate policy lead for the agency to integrate climate science into planning, research and implementation of programs in the Habitat Division .” POP 101 “ provides $100,000 General Fund, one-time, to support increased legal costs associated with instream water rights disputes. The Department received $100,000 General Fund, one-time, in SB 5506 (2023) to help reduce the backlog of instream water right applications under protest. Approximately 16 disputes are expected to be resolved during the 2023-25 biennium bringing the current backlog to 166. ” POP 801 provides $10 million in General Funds for implementation of the Private Forest Accord. It “ was adopted by the Oregon Legislature in 2022 to implement a negotiated agreement between the timber industry and conservation groups concerning private forestland practices and the protection of natural resources. The Oregon Forest Practices Act (SB 1501, 2022) established the Private Forest Accord Mitigation subaccount within the Oregon Conservation and Recreation Fund to support projects that mitigate the impacts of forest practices. This package provides $10 million General Fund for deposit into the Private Forest Accord Mitigation subaccount, which is continuously appropriated to the Department for the PFA Grant Program” Oregon Dept. of Forestry: SB 5521 . info hearing March 10 & 11. Dept. of Geology and Mineral Industries (DOGAMI): HB 5010 Public hearing Feb. 5-6; Meeting materials LWVOR testimony Aggregate industry testified against the staffing and fee increases. LWVOR supports SB 836 , a bill that would significantly increase permit fees for mining related activities. See the agency’s presentation to understand the reasons for these increases. A public hearing was held on May 19 and the League provided verbal testimony on the proposed amendment (not posted). A Work Session was held May 28 where the -4 amendment was adopted. Sen. Golden had hoped to see an indexing of these fees so they would increase with costs over time. Sen. Manning mentioned a proposed budget note that would allow the industry more influence in these fees. The League will be paying attention to the budget note language to be sure it meets standards. The fiscal impact statement indicates a substantial increase that will allow the agency to hire more staff and maybe even do more inspections. The bill now goes to Ways and Means. Oregon State Marine Board (OSMB): HB 5021 and HB 2558 A modifies the definition of "charter guide" for purposes of outfitter and guide laws and HB 2982 A , a bill that increases boating permit costs estimated to increase revenue to OSMB by about $1 million for the 2025-27 biennium, most of which will be used to address Aquatic and Invasive Species (AIS) management in partnership with the Oregon Dept. of Fish and Wildlife were considered together. COASTAL ISSUES After researching marine reserves as part of our Coastal Study , and supporting them with new League positions, it is good to see Oregonians support them. “Researchers from Oregon State University (OSU) and the Oregon Department of Fish and Wildlife (ODFW) have been collecting data on local residents’ attitudes toward the state’s marine reserves for more than a decade. Their work showed these Oregonians viewed the marine reserves in an increasingly positive light over time. Residents who live near the reserves and residents of densely populated metropolitan areas had the most favorable views overall. Their new research paper presents a fresh analysis of these attitudes and how they have changed over time.” The League supports HB 3580 eelgrass stabilization LWVOR signed letter of support and HB 3587A Protection of Rocky Habitat LWVOR signed letter of support ( fiscal impact statement ). To help these bills get funded, consider LWVOR’s Action Alert . The League signed on to a letter of support for HB 3963 , a bill that extends the timeline for the Dept. of Land Conservation and Development to provide a report on offshore wind conversations from 2025 to 2027. A public hearing was held May 19. The League signed on to testimony in support. A work session was held May 29 where the bill passed committee in a partisan vote and is headed to the House floor. The Oregon Coastal Management Program (OCMP) is currently developing its 2026-2030 Program Enhancement Assessment and Strategy. Draft Strategy The OCMP has selected to focus on wetlands, coastal hazards, and ocean resources in this 2026-2030 planning horizon. OF ENVIRONMENTAL QUALITY (DEQ) By Peggy Lynch The League supports SB 830 , a bill that modifies provisions of the on-site septic system loan program to allow for grants. It also allows for the program to consider mobile home parks in need of septic upgrades. May 28: Governor signed! Now we hope that Ways and Means will pass HB 2168 to fund this program. LWVOR testimony in support. SB 1154 was filed by the Governor to address the groundwater/nitrate issue in Morrow and Umatilla counties per this OPB article . See also in the Water section for a presentation of interest. The bill is sitting in Senate Rules while negotiations continue. DEPT. OF GEOLOGY AND MINERAL INDUSTRIES (DOGAMI) By Joan Fryxell The Central Oregon Geoscience Society’s presentation earlier this week, on Carbon Sequestration, by Richard Walker of DOGAMI was very interesting ( https://www.cogeosoc.org/event-5991444 ). The two things he made clear were: 1. They are definitely looking at the already fractured (and therefore permeable) zones at the flow tops and bottoms, to avoid needing to do any fracking. 2. The proposed project that is in front of the legislature this session is to drill cores and evaluate both the cores and the down-hole characteristics of the rock, and not to inject any CO2-charged fluids. They are proposing to do the background research first,so they have a very good idea of what the rocks are like before they do anything further. See above in “Budgets” information on the DOGAMI fee bill, SB 836. ELLIOTT STATE RESEARCH FOREST (ESRF) Habitat Conservation Plan adopted for the ESRF per this press release . “ The U.S. Fish and Wildlife Service today announced approval of the habitat conservation plan for the Elliott State Research Forest and issuance of an Endangered Species Act permit for implementing the plan over the next 80 years. “ FORESTRY The Board of Forestry meets June 4 and 5 per this press release . GOVERNANCE HB 3569 , a bill that would require a Chief Sponsor (legislator) of a bill to be a part of a rules advisory committee for legislation they had a hand in passing, passed the House and now goes to Senate Rules. The League provided testimony with our concerns and opposition to the bill for the public hearing that was scheduled for May 28. The hearing was postponed to June 4 and a work session set for June 5. Because the League is often engaged in rulemaking, we regularly comment on legislation that would affect changes in Oregon’s current Administrative Rules. We have provided testimony in opposition to HB 2692 , a bill that would create complicated and burdensome processes for agencies to implement legislation with their rulemaking procedures. The League joined others in sharing concerns about this bill to members of House Rules. It was pulled from the scheduled work session on May 28th. The League continues to follow the bills listed on the March 17 agenda of the Senate Committee On Rules since some of the bills relate to the process of rulemaking ( SB 437 , SB 1006 , SB 370 , SB 483 ) and SB 411 , SB 895 also in Senate Rules. HB 2454 passed House Rules with the -1 amendment and sent to Ways and Means. The bill creates a new Audits Officer (with possible additional staff). The Jt. Audits Committee would hire the Officer. It is unclear, if funded, what the relationship will be with the Secretary of State’s Audit Division and the work of the Legislative Fiscal Office staff. We are concerned with HB 3382 , since the requirements of the Secretary of State to gather ALL the state agencies’ rulemaking, including all materials would be overwhelming. Individual state agencies provide that information on their rulemaking websites. A work session was held May 28 where the -2 amendment was adopted todelay the web work and the bill sent to Ways and Means. Separately, the League was invited to a conversation among state agency rules staff on addressing concerns of the Governor and in an attempt to standardize the process statewide. The Governor has provided Rulemaking Guidance to state agencies: This document includes questions received from agencies since the Governor’s letter. This document includes additional resources for agencies including direction to post updates to the Transparency site, a website template that agencies can use (if they choose) to develop their pages, and links to other comprehensive agency rule making sites to review. There is a broader discussion to increase transparency and consistency in the state agencies’ rulemaking process. A second meeting related to the state agency rules process is set for June with an invitation to the League to continue to participate. See also the Governance section of this Legislative Report. LAND USE & HOUSING By Sandra U. Bishop/Peggy Lynch HB 2647 passed the House floor and was assigned to the Senate Housing and Development Committee where it passed the committee with the A 5 amendment and now goes to the Senate floor. HB 3921 is a bill that will allow by law land swaps for City of Roseburg/Douglas County per this preliminary staff analysis . The Governor has signed. The League provided testimony in support of HB 3939 , a bill that provides a list of infrastructure projects to fund for smaller Oregon cities so they can build more housing. We have also supported HB 3031 A (already sitting in Ways and Means) but know there might be limited dollars this session so called out that link in our letter. The -1 amendment to HB 3939 was adopted and the bill moved to Ways and Means. HB 2316 : Allows designation of Home Start Lands to be used for housing. HB 2316 -4 frees up approximately 3,500 acres of state land of which can now be used for housing production, all within the urban growth boundaries. It provides revenue to the state from the sale of the land, and it also provides revenue to our cities because the land becomes taxable for property taxes five years after purchase. The bill was sent to Revenue where a public hearing was held on May 15 and a work session was held May 27. The A6 amendment was adopted and the bill sent to Ways and Means. See also the Housing Report in the Social Policy section of this Legislative Report. OREGON ENVIRONMENTAL RESTORATION COUNCIL (OERC) A new Council has been created by the Governor to administer the settlement funds from the Monsanto legal settlement: “ The Oregon Environmental Restoration Fund (OERF or Fund) was established in 2024 by Senate Bill 1561 to invest the proceeds of a historic, nearly $700 million settlement against Monsanto for long-term harm caused by the company’s polychlorinated biphenyls (PCB) chemicals to Oregon’s land, water, fish and wildlife. The proceeds of the settlement will go to projects and purposes that benefit Oregon’s environment and its communities. “ “ The Fund has been set up to function similarly to an endowment. The settlement dollars will earn investment and interest income, and, on a biennial basis, the Council will authorize the Oregon Watershed Enhancement Board (OWEB) to distribute that income to three sub-funds: The Tribal Nation Natural Resource Program Fund will distribute 25% of the disbursement to federally recognized sovereign tribal nations (Tribes) in the state of Oregon. These payments will be made in equal amounts to each of the nine federally recognized Tribes who may use funds to invest in their stewardship of natural resources. The State Agency Program Fund will receive 50% of the disbursement to support the work of state agencies whose mission has a nexus with the settlement terms. The Disproportionately Impacted Community Fund will receive 25% of the disbursement. A grant program will support projects and programs that directly benefit impacted communities. “ TRANSPORTATION A report by an independent firm finds issues at ODOT per this article by OPB. “ The Oregon Department of Transportation is beset by high staff turnover, decades-old financial software, cost overruns and delays that have eroded trust with elected leaders .” WATER By Peggy Lynch HB 3806 , a bill that authorizes the Oregon Water Resources Commission to approve a Deschutes River water bank pilot program if the charter is approved by the Confederated Tribes of the Warm Springs and adheres to all requirements. It sunsets the pilot program on January 2, 2034, had a work session in Jt. Ways and Means Subcommittee on Natural Resources on May 29th. It was noted that funding for this pilot will be provided by the Deschutes River Conservancy. The bill passed and was sent to Full Ways and Means. LWV Deschutes County submitted a letter in support of SB 427 , a water rights transfer bill meant to protect instream water flows. A work session was held April 8 where the bill was sent to Senate Rules. SB 1153 , an alternate bill provided with help from the Governor’s office had a work session April 8 where the bill was sent to Senate Rules. After weeks of negotiations, a public hearing is set for June 3 with a work session set for June 5 on SB 1153. A -3 amendment is being proposed. Water Right Process Improvements ( HB 3342 ). A - 4 amendment was adopted and the bill passed the House. Amended by the A 8 amendment, it passed the Senate. On May 29th the House concurred with the Senate amendment and it passed the House floor. Harney Basin Groundwater Management ( HB 3800 ). A work session was held and the bill was sent to House Rules without recommendation as to passage. Water Rights and Public Interest ( HB 3501 ) A work session was held and the bill was referred to House Rules without recommendation as to passage on a 6 to 3 vote. HB 3525 is related to tenants’ right to well water testing. The League submitted testimony in support. House Rules had a public hearing April 30. A work session scheduled for May 12 has been cancelled. A number of amendments have been offered. The controversy seems to be around timelines for testing—how often—and what exactly gets tested. The League hopes to see this bill move forward, even if there are constraints. It would be a beginning and a recognition that water needs to be safe for everyone-homeowners and renters. League members may want to check the U. S. Drought Monitor , a map that is updated every Thursday. An Abnormally Dry designation has increased in NE and NW Oregon and now we also see our first level of Drought (Moderate) in some of those areas. Here is a more complete website about drought in Oregon. We all need to pay attention to the potential for harmful algal blooms (HABs). “When in doubt, stay out.” Visit the Harmful Algae Bloom website or call the Oregon Public Health Division toll-free information line at 877-290-6767 to learn if an advisory has been issued or lifted for a specific water body. As the weather gets warmer and more people and animals visit Oregon’s water bodies, it is important to watch for potentially deadly algal blooms. Information on current advisories can be found on the OHA’s cyanobacteria bloom webpage at healthoregon.org/hab . The OHA has an online photo gallery to help community members identify signs of potentially harmful blooms. As a result of concern around HABs along the coast, the Oregon Dept. of Fish and Wildlife budget includes “one permanent full-time Natural Resource Specialist 2 position (0.88 FTE) and two permanent 12-month seasonal Biological Science Assistant positions (1.00 FTE) to monitor and respond to harmful algal blooms along the coast. The revenue source is recreational shellfish license fee revenue. WILDFIRE By Carolyn Mayers Along with the transportation package, wildfire funding has been a challenge for the legislature. The Governor has weighed in on the concept of taking at least a part of the “kicker” to fund wildfire: lawmakers have an option if they can agree on a better use for the kicker money. With two-thirds supermajority vote in each chamber, they can opt to suspend the refund. That’s happened once since the policy was enacted in the late 70s. A 2/3rds supermajority vote means at least two Senate Republicans and four House Republicans would need to approve along with all legislative Democrats. Because our Rural Fire Protection Associations (RFPAs) are seeing a huge increase in their fire fees, Rep. Owens has offered the following: I introduced HB 3349 and HB 3350 to ensure our RFPAs have access to the tools they need. These bills propose establishing a dedicated funding stream to help RFPAs obtain gear from the Oregon Department of Forestry and better access federal resources. Importantly, this support does not change their volunteer status but simply gives them the resources to be more effective and safe while serving our communities. Then the House Leadership decided to move SB 83 , which would repeal the State Wildfire Hazard Map and accompanying statues related to it, to House Rules at a Work Session on May 20. It seems that the bill is now being used as trade bait to find funding for wildfire according to a news release from Sen. David Brock Smith. SB 75 A , removes the wildfire hazard map as a guide for allowing ADUs and requiring higher building codes in rural areas. The bill was moved to House Rules on May 22nd by the House Committee on Climate, Energy and Environment where it is likely to stay while negotiations continue on wildfire funding. The Oregon Capital Insider provides information on the Dept. of Forestry’s budget and what’s happening at the federal level. Here is a short report on the status of the bills mentioned last week: SB 860A The bill would allow the State Fire Marshal and an agency to take actions for fire protection and makes changes related to the Governor's Fire Service Policy Council. The Governor’s signed. SB 861 , a measure which would include grant funds, reimbursements, and moneys received from judgements and settlements as funds in the State Fire Marshal Mobilization Fund has been signed by the Governor. It requires that the Department of the State Fire Marshal submit a report to the Joint Committee on Ways and Means on the amounts in the fund and expenditures from the fund on or before March 31 of each odd numbered year. SB 85A directs the State Fire Marshal to establish a neighborhood protection cooperative grant program to help communities collectively reduce their wildfire risk. May 28: Governor signed! The Omnibus wildfire funding bill, HB 3940A , had a robust Public Hearing before the House Committee on Revenue on May 1. Legislative Revenue staff provided a table to help understand the various elements of the bill. Oregon Department of Forestry and Oregon State Fire Marshal’s Office have stated the minimum annual need for wildfire funding to address the growing wildfire crisis is around $280 million. SB 1177 is still before the Senate Committee on Finance and Revenue. It had a public hearing on April 7. This bill would establish the Oregon Wildfire Mitigation and Adaptation Fund and redirect the “kicker” to it, one- time, for financing wildfire-related expenses, by using the interest earned. A 5% return would yield approximately $170-180 million per year, or just over half of the aforementioned projected ongoing costs to fund wildfire mitigation and suppression. (The Governor has expressed interest in using only the amount of kicker that would go to large income earners for wildfire costs.) SJR 11 also remains before the Senate Committee on Finance and Revenue after its April 7 public hearing. It would dedicate a fixed, to-be-determined percentage of net proceeds of the State Lottery to a wildfire fund created by the Legislature. Its passage would mean an amendment to the Oregon Constitution, which would have to go to the voters for approval. Finally, HB 3489 , which imposes a severance tax on owners of timber harvested from public or private forestland, had a Public Hearing April 24 before the House Committee on Revenue. The League has supported a severance tax in past sessions and provided testimony at the hearing. The League is also still following other non-funding related bills, such as SB 926 , which would prohibit the recovery of certain costs and expenses from customers that an electric company incurs as a result of allegations of a wildfire resulting from the negligence or fault on the part of the electric company. It was passed by the Senate and had a work session on May 20 in the House Committee on Judiciary where the A 10 amendment was adopted. The Speaker sent the bill to Ways and Means. HB 3666 remains in the Rules Committee. This bill would establish wildfire mitigation actions and an accompanying certification for electric utilities in an attempt to standardize their approach. SB 1051 , which transfers the authority to appoint a State Forester from the State Board of Forestry to the Governor, subject to Senate confirmation, remains in the Senate Rules Committee. Back to Legislative Report Education Legislative Report - Week of 2/6 By Anne Nesse, Education Portfolio House Education Meeting 2/6/23 3PM, takes an important look at locally elected school board responsibilities and the non-discriminatory rights of all students. We submitted written and virtual testimony on SB 2750 , which prohibits charging fees or requiring participation in fundraising activities as a condition of participating in interscholastic activities. The law also includes authorization to use moneys in Statewide Education Initiatives, Account for costs incurred by school districts, and public charter schools as result of this law. The law does not prohibit communities from raising such monies needed to fund the law. Our testimony made clear that the LWV, since its founding, has believed in the fundamental right of equal rights by law, to a non-discriminatory public education, without asking families to pay additional fees for education or recreational services. There was only positive testimony on this Bill, with some concern about the high potential cost. A number of school districts have already begun, and are succeeding in eliminating “pay to play” fees. I was able to add my personal experience of coaching after school interscholastic activities, in two areas: team critical thinking and problem solving competitions in Odyssey of the Mind, and instructing after school string orchestra. Here is the recording of public hearing of this Bill , held first on the agenda. A public hearing was held on HB 2751 , to establish a Task Force to study and collect data on school starting times. Much convincing long term medical, health, and educational data was presented, as to why High School and Middle School students should not start school before 8:30AM, while younger grade levels can usually adapt. A public hearing was held on HB 2753 , allowing a district school board to choose to provide directors with a monthly stipend, and requires the board to provide reimbursements for actual and necessary expenses if board does not provide stipend. There was little data presented about the difficulty of filling school board vacancies. The amount of work required to be a school board member was considered significant enough to warrant a modest salary of some kind. Details and potential consequences of this Bill have yet to be worked out. A public hearing was held on HB 2669 , declaring children who are deaf, hard of hearing or deaf-blind have the same rights and potential as children who are not. Requires school districts to provide children who are deaf, hard of hearing or deaf-blind with hearing and vision screenings and assessments, communication and language support and access to relevant services and programs at the earliest possible age and throughout education experience.
